A. 
A code is hereby adopted by the Borough of Carteret for the purpose of establishing rules and regulations concerning electrical construction and electrical equipment. A copy of the code is attached to and made a part of this chapter without the inclusion of the text herein.
B. 
The code adopted and established by this chapter is commonly known as "Article 21, the Electrical Subcode."

(1) 
Pursuant to authority of P.L. 1975, c. 217,[1] the Borough of Carteret adopts the model code of the National Fire Protection Association known as the "National Electrical Code/1975," including all subsequent revisions and amendments thereto, as the Electrical Subcode for New Jersey.

As used in this chapter, the following terms shall have the meanings indicated:
AGENCY
The Middle Department Inspection Agency.

A fee of two dollars ($2.) shall be paid to the Construction Official for an electrical permit. All other fees shall be in accordance with the requirements of the Inspection Agency.

A. 
Application for inspection.
(1) 
Before any person shall install, extend or renew any electrical wiring or fixed electrical equipment, he shall first file an application for inspection with the Construction Official and the Middle Department Inspection Agency and pay any required application or inspection fees as may be determined from time to time by the Borough of Carteret and the Agency.
(2) 
When emergency repairs are necessary in order to maintain service on an electrical system, the repairs may be made without first filing an application for inspection. In such cases, the application shall be filed not later than the next working day after the date on which the repairs were made.
B. 
When inspection to be made.
(1) 
The Inspection Agency shall, upon receipt of the application and within a reasonable time after notice of completion of electrical work, make or cause to be made an inspection of the work and any tests which may be necessary to determine that the installation conforms to the provisions of this chapter.
(2) 
The Inspection Agency shall, upon written request from the Construction Agency shall, upon written request from the Construction Official of the borough or any of his authorized agents, make or cause to be made an inspection of any existing electrical installation warranting such an inspection. The Inspection Agency shall file with the Construction Official a report of all inspections made and shall have the authority during reasonable hours to enter any building or premises for the purpose of making an inspection or test of the electrical installation.

The Construction Official shall keep on file a record of all violation reports received from the Inspection Agency until such violations are corrected and approval is issued by the Inspection Agency. When an electrical installation which is connected to the supply of electricity has been reported in violation of the requirements of this chapter, the Construction Official or any of his authorized agents shall notify the person owning or using the installation. If, after a period of ten (10) days has elapsed, or such further reasonable time as may be granted upon request, the installation has not been approved by the Inspection Agency, the Construction Official shall have the authority to disconnect or order disconnection of the electrical service to the electrical installation. In cases of emergency, when safety to persons or property or when electrical equipment may interfere with the borough, the Construction Official shall have the authority to disconnect or order the disconnection immediately of service to electrical installations.
The provisions of this chapter shall not apply to work done in connection with lines or equipment owned by a public utility pursuant to N.J.S.A. 48:2-13 and directly used in supplying its service.
A. 
Concealment of wiring before inspection prohibited. Electrical wiring shall not be concealed by permanent placement of parts of a building until the wiring has been inspected and approved by the Inspection Agency.

B. 
Conformity of installations. Conformity of electrical installations to applicable regulations set forth in the code adopted by this chapter shall be prima facie evidence that such installations are reasonably safe to persons and property.
C. 
Conformity of equipment. Conformity of electrical equipment to applicable standards of Underwriters Laboratories, Inc., shall be prima facie evidence that such equipment is reasonably safe to persons and property.
D. 
Safety to persons and property.
(1) 
All electrical construction and electrical equipment shall be reasonably safe to persons and property and in conformity with the provisions of this chapter as well as the applicable statutes of New Jersey and all orders, rules and regulations issued by the Authority.
(2) 
As used in this chapter, "reasonably safe to persons and property," as applied to electrical construction and electrical equipment, shall mean safe to use in the service for which the installation or equipment is intended without hazard to persons or property.

Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to the penalties set forth in § 1-17 of this Code.
