The purpose of this Article is to protect children under the age of eighteen (18) years of age from exposure to sexually explicit publications sold in stores within the Borough of Carteret.
As used in this Article, the following terms shall have the meanings indicated:
BEHIND THE COUNTER
An area out of plain view accessible to only employees of the retail establishment.
COMMERCIAL ESTABLISHMENTS
Retail premises which sell goods or services to the general public.
SEXUALLY EXPLICIT PUBLICATIONS
Magazines, newspapers, books, which have pictures, articles and covers which show men and/or women in sexually explicit poses or partially clad.
All sexually explicit publications being sold by retail establishments shall be stored behind the counter and out of the sight of minors under the age of eighteen (18) years of age.
Any person who violates any provision of this Article shall, upon conviction, be subject to the penalties set forth in § 1-17 of the Code of the Borough of Carteret.
