[HISTORY: Adopted by the Township Committee of the Township of Delanco 9-9-2002 by Ord. No. 2002-10. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated.
ENFORCING OFFICIAL
Delanco Township Police Department.
ROLLER SKATE(S)
Any device that is affixed to or worn on the feet onto which are mounted wheels. This shall include what are commonly known as “in-line skates,” “roller blades” and/or “roller skates.”
SKATEBOARD
A platform or other board which is mounted on wheels or a board with roller skate wheels or other similar wheels affixed to the underside having no mechanism or other device with which to steer or control the direction of movement thereof while being used, operated or ridden.
A. 
All skaters must skate safely and responsibly and are responsible for the maintenance and repair of their equipment.
B. 
Entrance will be on a first-come-first-served basis and is limited to one hour when there are skaters waiting.
C. 
All skaters must wear the following safety equipment at all times: helmet with safety strap (helmet must be strapped), elbow pads and kneepads. The helmet must be properly fitted and meet the helmet standards of the American National Standards Institute (ANSI Z90.4 helmet standard) or the Snell Memorial Foundation’s 1984 Standard for Protective Headgear for Use in Bicycling. Those using skateboards must wear fitted shoes (no bare feet or sandals).
D. 
An adult must accompany all children seven years of age and under who wish to utilize the Skate Park.
E. 
The hours of the operation for the Skate Park will be from 9:00 a.m. to dusk. Any person attempting to use the Skate Park during any other time shall be subject to immediate ejectment, in addition to any other penalties provided in this chapter.
F. 
The Skate Park is for skateboards and in-line skates only. No other use is permitted in or on the Skate Park whatsoever. Users shall use their skateboards and in-line skates for their intended use only, and shall not use them in an unsafe manner, throw or otherwise project them, or use them in an altercation.

G. 
Use of profanity or abusive language is strictly prohibited and shall result in automatic expulsion from the Skate Park and any penalties provided for in this chapter.
H. 
No skating is permitted when surfaces are wet and icy.
The Recreation Commission, upon the review and consent of the Township Committee, shall have the power to establish, by resolution, additional rules and regulations for the use and control of the Skate Park. Any such rules and regulations shall be posted at the Skate Park and shall have the same force and effect as any other provision of this chapter, and the violation thereof shall constitute a violation of this chapter.
No person shall operate or ride upon any skateboard, roller blades, roller skates or any other human-powered recreational device upon the following areas:
A. 
Parking lots, specifically but not limited to the parking lots at the Camp Meeting Grounds (front and back areas), the Delanco Federal Savings Bank and the Walnut and Pearson Street Schools.
B. 
The Walnut Street School walls and surrounding area.
A. 
A person who violates any requirement of this chapter shall be warned of the violation by the enforcing official.
B. 
After the initial warning, any person who violates or fails to comply with any of the provisions of this chapter or any of the rules and regulations established pursuant hereto shall be immediately ejected from the Skate Park and be subjected to a fine of $25 for the first offense.
C. 
The second offense will be subjected to a fifty dollar fine.
D. 
The third offense will result in permanent forfeiture of the privilege to use the Skate Park and a fine of $100.
E. 
In addition to or in lieu of the aforementioned fines, the Municipal Court may impose a period of community service.
F. 
Impoundment. In addition, if the Delanco Township Police or other enforcement officer determines that a user is using the skate park with skateboards or skates in an improper or unsafe manner, or with a bicycle, scooter or any other nonpermitted vehicle, then the skateboards, skates, or nonpermitted vehicle may be impounded. Impounded vehicles will be returned to the user or, in the instance of a minor, the user’s parent or legal guardian at the Delanco Township Police Department upon payment of a fee of $25.

All fines imposed and collected under and by virtue of this chapter shall be paid into the treasury of the Township of Delanco.
