Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383; N.J.S.A. 52:27D-202), the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1.1 et seq.) shall be locally enforced in the municipality of the Township of Franklin.
The local enforcing agency shall be the Commissioners of Franklin Township Fire District No. 1, County of Hunterdon, State of New Jersey. The Fire District Attorney and/or Township Attorney is/are hereby appointed to assist the Bureau of Fire Prevention as to all legal matters.
The local enforcement agency shall enforce the Uniform Fire Safety Act (N.J.S.A. 52:27D-192 et seq.) and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of the Township of Franklin, other that owner-occupied one- and two-family dwellings and buildings owned or operated by the federal government, the state and interstate agencies and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The local enforcing agency established by § 193-2 of this chapter shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
The local enforcing agency established by § 193-2 of this chapter shall be under the direct supervision and control of the Fire Marshal/Fire Official, who shall report to the Commissioners of the Fire District
A. 
Fire Official/Fire Marshal.
(1) 
Appointment. The local enforcing agency shall be under the supervision of the Fire Official/Fire Marshal, who shall be appointed by the Franklin Township Fire District No. 1 Commissioners, Franklin Township, Hunterdon County, New Jersey.
(2) 
Term of office. The Fire Official/Fire Marshal shall serve for a term of one year. Any vacancy shall be filled for the unexpired term.
B. 
Inspectors and employees. Such inspectors and other employees as may be necessary in the local enforcing agency shall be appointed by the Franklin Township Fire District No. 1 Commissioners upon the recommendation of the Fire Official/Fire Marshal.
C. 
Removal from office. The Fire Official/Fire Marshal and other employees of the enforcing agency shall be subject to the removal by the Fire Commissioners of the Fire District for inefficiency or misconduct. Each Fire Official/Fire Marshal, inspector or employee to be so removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act (N.J.S.A. 52:27D-206 and 52:27D-208, respectively), any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the Construction Board of Appeals of Hunterdon County.
Permit fees charged by the Bureau of Fire Prevention shall be those established by N.J.A.C. 5:18-2.8(c) and are therefore consistent with the Uniform Fire Code. The current fee schedule is shown in Chapter 182, Fees, of the Code of the Township of Franklin.
