GENERAL REFERENCES
Salaries and compensation — See Ch. 37.
The position of Code Enforcement Officer is hereby established in the
Township of Franklin in the County of Warren.
Said position shall require the following minimum qualifications for
the position:
A.
The person shall be at least 21 years of age.
B.
The person shall also be of good moral character.
C.
Said person shall have the ability to read, write, speak
and understand the English language sufficient to perform the duties of the
position.
D.
Said person shall not be required to be a resident of
the Township. However, a qualified resident of the Township shall be given
priority in said appointment. The position shall be filled by a resident of
the State of New Jersey.
E.
Said person shall have considerable knowledge of the
provisions of the municipal ordinances, rules, regulations, policies and procedures
as codified in the Code of the Township of Franklin.
F.
Said person shall have the ability to organize the work,
developing effective work methods, both in the field and in the office.
G.
Said person shall have the ability to analyze, comprehend
and interpret municipal ordinances, rules, regulations, policies and procedures
and apply them to specific cases.
The Code Enforcement Officer shall be appointed by the Mayor and shall
serve for a term of one year.
The salary for the position shall be set and adjusted annually by the
general Salary Ordinance of the Township of Franklin in the County of Warren.[1]
The Township Committee may set the minimum days and hours that the Officer
must be available on a regular scheduled basis at the Franklin Township Municipal
Building.
The duties of the Code Enforcement Officer shall be as follows:
A.
The Code Enforcement Officer shall attend one regular
Township meeting per month and submit a monthly report as to the duties performed.
B.
The Code Enforcement Officer shall attend all Township
Board of Adjustment and Planning Board meetings and shall coordinate with
the Secretary of said respective Boards for obtaining copies of all resolutions
and determinations if any matter is heard.
C.
It shall be the Code Enforcement Officer's responsibility
to observe and collect facts and conduct proper investigations in determining
whether any provisions of the Township Code, rules and regulations of the
Township are being violated and to establish and maintain records and files
thereon on behalf of the Township.
D.
Said Officer shall further take all proper action as
called for, within prescribed procedures; make and record acts and observations;
maintain records thereon, as well as records of any inspections and investigations;
create and adopt clear, concise and actual forms for reports and applications;
and seek advice of municipal counsel for guidance and an interpretation of
the Code and rules and regulations.
E.
Said Officer shall further provide zoning clearance letters
to the Building Inspector and, if by interpretation any requests therefor
are not in conformance with the Township Code or Township rules and regulations,
direct said applicants to attend the Committee, Planning Board or Board of
Adjustment meetings.
F.
Said Officer shall further file complaints in a Municipal
Court or any higher court in the violation of any of the provisions of the
Township Code or rules and regulations of the Township, on his own initiative
or by direction of the Township Committee.
G.
Said Officer shall further have the specific responsibility
of Code enforcement:

It shall be the responsibility of the Code Enforcement
Officer to enforce the following enumerated ordinances as set forth in the
Code of the Township of Franklin in the County of Warren:

It shall further be the duties of the Code Enforcement
Officer to work together with the proper officials in further enforcing the
following Code provisions of the Township of Franklin:

Although the Code Enforcement Officer's primary responsibility shall be enforcing the above provisions of Subsection G(1), and jointly in regard to those Code provisions under Subsection G(2), the delegation of the enforcement duty to the Code Enforcement Officer of those provisions shall not preclude other municipal employees and officials from enforcing said Code provisions.
