It shall be unlawful for any person, persons,
club, association, firm, corporation or other organization to install,
operate, maintain or use in any public or quasi-public place or in
any building, store or any other place where the public is invited
or may enter within the Township of Hainesport any bagatelle device
or pinball machine or any coin-operated mechanical device or machine
for amusement purposes or for the production of music, including jukeboxes,
Victrolas, orchestrelles, player pianos, music vending machines and
other instruments, whether electrically operated or not, operated,
maintained or used for amusement purposes without a license first
had and obtained as hereinafter provided.

The fee for such bagatelle devices, pinball machines or paid
mechanical or electronic devices for amusement purposes shall be $50
for each machine, and for each such machine for the production of
music, such as but not limited to jukeboxes, digital jukeboxes, or
other forms of pay-per-play music devices, the fee shall be $50 for
each machine for one year, which said license fee is imposed for revenue
purposes.
Each such license shall expire December 31 of
the year in which issued unless suspended or revoked, and the license
fee shall not be prorated.

Every applicant for a license shall fill out a form of application
to be furnished by the Township Clerk, who shall submit the application
to the Township Committee and, pending its approval, shall issue the
license as herein provided upon payment of the appropriate license
fee.
Each such license shall be prominently displayed
at all times in the premises where said machine is located.

Such bagatelle devices or pinball machines or
coin-operated mechanical machines for amusement purposes or for production
of music, which shall be so licensed, shall be so licensed for amusement
purposes only; and no such machine or other mechanical device of any
kind or nature shall be used in connection with a gaming lottery,
the awarding of prizes, whether cash, merchandise or tokens, or any
other unlawful activity; and the Township Committee may, in its discretion,
after two days' notice and hearing, summarily revoke any such license
for violation of any of the provisions of this chapter or for violation
of such rules and conditions as the Township Committee may make, from
time to time, in connection with the issuance of such license for
maintaining, operating or using such machine or device so licensed
and may order that no further license be issued to the same person
or premises.

Any person or persons, club, association, firm,
corporation or other organization violating any of the provisions
of this chapter shall, upon conviction thereof, be subject to one
or more of the following, at the discretion of the court before which
said conviction shall be had: a fine not exceeding $2,000, imprisonment
in the county jail of the County of Burlington for a term not exceeding
90 days or a period of community service not exceeding 90 days. The
Township waives the additional fine for a violation of an ordinance
within one year of a previous violation of the same ordinance, provided
in N.J.S.A. 40:49-5.
