A. 
Pursuant to the authority of Chapter 188 of the Laws of the State of New Jersey 1950, as supplemented and amended (N.J.S.A. 26:3-69.1 et seq.), there is hereby adopted by the Township of Hainesport the entire code of rules and regulations printed in booklet form as a code and constituting and known by its common name as the "Public Health Nuisance Code of New Jersey (1953)," except that Section 2.1(a) and (b) are excluded from this adoption, a printed copy in booklet form of which code, plainly marked so as to indicate which portions are to be adopted if less than the whole of such code, is annexed hereto and made a part hereof as fully as if set forth herein. The rules and regulations of this code are hereby ordained to be the rules and regulations for the specification, regulation or prohibition of conditions hazardous and inimical to the health and general welfare of the citizens of this Township, and from the date of which this chapter shall take effect, the provisions thereof shall be controlling within the limits of the Township of Hainesport.

Three printed copies in booklet form of the code annexed to this chapter, similarly marked so as to plainly indicate what portion thereof is intended to be adopted if less than the whole of such code, have been placed on file in the office of the Secretary of the Board of Health and the office of the Burlington County Health Inspector upon the introduction hereof and will remain on file there until final action is taken hereon and shall thereafter remain on file for so long as this chapter is in effect for use and examination by the public.

Said code annexed to this chapter shall not be published as part of this chapter either before or after final passage hereof.

The Public Health Nuisance Code of New Jersey (1953) shall be enforced by the Board of Health and the Burlington County Health Inspector.

The Burlington County Health Inspector shall have the power to modify any of the provisions of this code, upon application, in writing, by an owner or lessee, subject to the approval of the Township Board of Health, when it is just and reasonable and there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured and substantial justice done. The particulars of such modification, when granted or allowed, and the decision of the Burlington County Health Inspector thereon shall be entered in the records of the Board of Health, and a signed copy shall be furnished the applicant.
A. 
Any person who shall violate any of the provisions of the code hereby adopted or fail to comply herewith or who shall violate or fail to comply with any order made thereunder shall severally, for each and every such violation and noncompliance respectively, be guilty of violating this chapter, punishable by a fine of not less than $5 nor more than $500, within the discretion of the Judge before whom such conviction is obtained. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violations or defects within a reasonable time, and, when not otherwise specified, each 10 days that prohibited conditions are maintained shall constitute a separate offense.

B. 
The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
