In the event a resident of the Borough of Hamburg dies as an indigent
within the Borough of Hamburg, the Borough shall pay for the resident's
funeral expenses to the extent of 75% of the Social Security Insurance or
the actual funeral expenses, whichever is less. Additionally, in the event
the decedent is to have a ground burial, he/she shall be entitled to 75% of
the Social Security Insurance Ground Burial Benefits or the actual ground
burial costs, whichever is less.
An indigent may be cremated provided a qualified relative consents to the cremation, as required by law. The amount payable for cremation shall not exceed the amounts set forth in § 127-1.
The determination as to whether or not the decedent is indigent shall
be made by the Municipal Welfare Director or such person as designated by
law and in accordance with the applicable state law for establishing indigency.
