[HISTORY: Adopted by the Township Committee of the Township of Independence 6-13-1955 (Ch. 14 of the 1984 Code). Amendments noted where applicable.]
GENERAL REFERENCES
Salaries and compensation — See Ch. 89.
There is hereby created and established a Municipal Court in the Township of Independence, Warren County, New Jersey, to be known as the "Municipal Court of the Township of Independence," which shall be presided over by a Judge, to be known as the "Judge of the Municipal Court." Said Court is created under and by virtue of N.J.S.A. 2B:12-1 et seq. and the acts supplemental thereto and amendatory thereof. The jurisdiction, powers, functions and organization of said Court and the qualifications, powers, terms of office and duties of the Judge of the Municipal Court shall be those set forth in the said statute and the said acts supplemental thereto and amendatory thereof.

The Judge of the Municipal Court shall be paid an annual salary to be provided for in the Annual Salary Ordinance,[1] which shall be paid in monthly installations.

The Township Committee shall appoint a Municipal Court Administrator, who shall also serve as Violations Clerk, whose compensation shall be as provided in the Salary Ordinance[2] and who, with the Judge of the Municipal Court, shall function according to and be governed by N.J.S.A. 2B:12-1 et seq. and the acts supplemental thereto and amendatory thereof. This Municipal Court Administrator may also hold other municipal office and/or perform other duties as prescribed by the Township Committee.

The Township Committee may, from time to time, appoint a Prosecutor of the Municipal Court, who shall conduct prosecutions for crimes and offenses, cognizable by the Municipal Court of the Township of Independence, including violations of ordinances of the municipality, complaints of any department or officers under state law and violations of rules and regulations duly promulgated by any department; provided, however, that the Prosecutor shall not be responsible for the prosecution of such crimes and offenses as are required by law to be prosecuted by the County Prosecutor. The Prosecutor shall be paid as provided in the Salary Ordinance[2] and shall function in accordance with N.J.S.A. 2B:12-1 et seq. as amended or supplemented.
