GENERAL REFERENCES
Snow and ice removal — See Ch. 329.
Streets and sidewalks — See Ch. 342.
All qualified private communities, as defined herein, shall be reimbursed for snow and ice removal and streetlighting in accordance with the formula established herein.
As used in this chapter, the following terms shall have the meanings indicated:
QUALIFIED PRIVATE COMMUNITY
Any condominium, homeowners' or property owners' association or cooperative which privately contracts for snow and ice removal and streetlighting or any organization where individual members privately contract for the above-referenced services. Presently, two developments in Independence Township qualify under the terms of this chapter, Oak Hill at Independence and the Hills at Independence.
A. 
The Township of Independence shall issue a check to each qualified private community by July 1 of each year as reimbursement for municipal service costs incurred by the Township for services covered herein the preceding calendar year. The amount of the reimbursement check shall be calculated annually in accordance with the formula as established in § 273-4 of this chapter and as otherwise defined in a reimbursement agreement to be entered into between the Township of Independence and the qualified private community.
B. 
Reimbursement checks received by qualified private communities from the Township of Independence shall be:
(1) 
Distributed to individual members in accordance with procedures established by the private communities; or
(2) 
Credited and applied against present and future association expenditures.
The amount of the annual reimbursement to individual qualified communities shall be calculated in accordance with the following figures for the calendar year 1995. The formula shall be reevaluated every year.[1]
