No person, firm or corporation shall pump water from any basement or well or otherwise cause or permit the discharge of any water or liquid substance upon or along any Township road, right-of-way, drain, catch basin, gutter, public way, street, highway or other public place, except in accordance with the terms and provisions of § 481-7.

The enforcement of this article shall be under
the supervision of the Director of the Department of Public Works
who shall cause suitable inspections to be made, where appropriate,
relative to compliance with this article and/or to investigate complaints
relative to noncompliance with this article. The Director of the Department
of Public Works or any police officer of the Township of Jefferson
may file complaints in the Municipal Court of the Township of Jefferson
for all violations of this article.
A.
Any person, firm or corporation seeking authority
to divert or discharge water from his or its property to, over or
along any public street, road, right-of-way, drain, catch basin, gutter,
public way, highway, culvert or other public place shall, prior to
causing such diversion or discharge, make application in triplicate
to the Construction Official, who shall forward copies to the Township
Engineer and to the Director of the Department of Public Works. The
application shall include a diagram of the design as to the proposed
method of discharge and the course of the same over the property of
the applicant and all other properties to the point of its discharge
upon a public way. Upon receipt of the application and plan by the
Township Engineer, he shall provide his recommendations to the Construction
Official to approve or deny the same. The Township Engineer shall
also set forth any recommendations he may have in a statement of approval,
setting forth conditions or specifications for construction so as
to protect the public health, safety and welfare.

B.
The Director of the Department of Public Works shall,
within 10 days of his receipt of a copy of the application, forthwith
notify the Township Engineer and Construction Official as to his approval
or disapproval of the application and any recommendations he may have
regarding the application.

C.
Nothing contained under these provisions shall be
construed to prohibit any discharge of water which is the result of
an approval granted by any state or federal agency.
D.
No fee is required for the application approval process
set forth in this article.

Any person who shall violate any provision of
this article shall, upon conviction thereof, be subject to a penalty
of a maximum fine of $2,000, imprisonment for not more than 90 days
or a period of community service for not more than 90 days, or any
combination thereof.
