Pursuant to N.J.S.A. 40:48-1.4, the purpose of this chapter is to authorize a municipal official or officer to request a criminal history record background check of any person for an official municipal governmental purpose, including, but not limited to, employment, licensing and the procurement of volunteer and nonvolunteer services.

The Borough of Kinnelon Chief of Police, or his designee ("officer"), is hereby authorized to request a criminal history record background check ("background check") of any person for an official municipal governmental purpose, including, but not limited to, employment, licensing and the procurement of volunteer and nonvolunteer services.
Any individual subject to a background check shall submit to being fingerprinted in accordance with applicable state and federal laws, rules, and regulations.
The officer is further authorized to exchange the fingerprint data with and receive criminal history record information from the State Bureau of Identification in the Division of State Police (SBI) and the Federal Bureau of Investigation (FBI).
The officer shall submit the fingerprint data to the SBI, who shall receive all criminal history record information from the FBI and shall disseminate that information to the officer.
The fees required for the background check shall be transmitted to the SBI.
This chapter was adopted in compliance with N.J.S.A. 40:48-1.4 and the rules and regulations promulgated thereunder at N.LA.C. 13:59-1.2 et seq. The officer shall comply with said state rules and regulations when requesting a background check of any individual.

A. 
The governing body shall approve the standards and criteria for the use and application of the criminal history record background check obtained under this section for the purposes as set forth above.
B. 
The Borough Administrator shall implement the standards and criteria approved by the governing body.
