The discharging or firing of a gun, pistol or firearm of any description at any place within the Borough of Kinnelon is hereby prohibited; provided, however, that this section shall not apply to any person, association or corporation who shall obtain the permission of the Borough Council, or such council or officer of the Borough as may be designated by the Borough Council, to discharge or fire a gun, pistol or firearm of any description for sport, recreation or for the protection of property nor to licensed hunters of the State of New Jersey.
Hunting with a gun, pistol or firearm of any description by any person upon or over the lands of any other person after being forbidden so to do by the owner, occupant, lessee or licensee of such lands or without the consent of the owner, occupant, lessee or licensee thereof after public notice on the part of the owner, occupant, lessee or licensee thereof forbidding such trespass is hereby prohibited. Such public notice shall bear the name of said owner, occupant, lessee or licensee and be posted conspicuously on the corners of said property, along the roads or highways abutting said property, on all boundary lines bordering on adjoining lands and at each point where a stream enters upon or leaves said property.
In any prosecution for the violation of the provisions of § 120-2 hereof, the failure of the defendant to produce a written permit to hunt with a firearm, as aforesaid, upon or over the lands where the violation is charged to have occurred, signed by the owner, occupant, lessee or licensee thereof, shall be prima facie proof that he has forbidden so to do by such owner, occupant, lessee or licensee.

Any person, firm or corporation violating this chapter shall be subject, upon conviction, to one or more of the following at the discretion of the court: a fine not to exceed $1,000 or imprisonment in the county jail for a term not to exceed 90 days or community service not to exceed 90 days.
