For the purposes of Chapter 61, "nonpaid beaches" are defined as all beaches and areas lying between the ocean and bay waters, to and including rock jetties, revetments, seawalls and bulkheads for the entire perimeter of the Borough of Longport not subject to riparian grants held by contiguous upland owners and not defined as a "paid beach" pursuant to Article I of this Chapter 61. The foregoing definition of nonpaid beach shall not expand the obligation of the Borough to protect any beach in addition to those defined in this Chapter 61, Article I, Regulation of Paid Beaches.
A. 
Each and every rule and regulation and hours of use pertaining to paid beaches pursuant to Article I of Chapter 61 is incorporated by reference in its entirety as if set forth herein at length except to the extent inconsistent herewith or with the Commissioner's published rules and regulations. In addition, no bathing, swimming or other in-water activity shall be permitted on nonpaid beaches except for fishermen fishing from the surf. The hours of use regulation shall not apply to fishermen fishing exclusively from rock jetties.
B. 
The Director of Public Works may adopt additional rules and regulations from time to time as the need arises. Such rules and regulations shall be posted on the public bulletin board in Borough Hall for no less than three consecutive weeks and kept on file in the Clerk's office.
Any person violating any of the provisions of this article or any of the rules and regulations adopted hereunder shall, upon conviction thereof, be subject to a fine of not more than $500 or to imprisonment for not more than 90 days, or to both such fine and imprisonment.
