The provisions of this article imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

In accordance with the state aid agreement with the New Jersey Department of Environmental Protection, executed July 27, 2007, for Project No. 4165-04, known as the "Longport Stone Revetment Project,"[1] a copy of which is on file in the Municipal Clerk's Office, the Borough of Longport assures all existing on-street parking along the south side (ocean side) of Atlantic Avenue between 17th Avenue and 22nd Avenue must be maintained as per the adopted municipal ordinances. All on-street parking shall be provided in a nondiscriminatory manner. The obligation of all on-street parking along the south side (ocean side) of Atlantic Avenue between 17th Avenue and 22nd Avenue cannot be modified or repealed in any manner without written consent from the New Jersey Department of Environmental Protection and/or the Office of the Attorney General.

A. 
Parking in front of driveways. Parking in front of private driveways shall be permitted when both the motor vehicle and driveway involved are owned by the same person, the motor vehicle is owned by a member of the same household as the owner of the private driveway, or the owner of the private driveway authorizes the parking of a motor vehicle in front of the private driveway. At all times that a vehicle is parked in front of a private driveway, such vehicle must display a validly issued permit which has been issued in accordance with Subsections B and C below. Nothing contained in this section shall permit parking on a street where parking is otherwise prohibited or the permitting thereof would interfere with the normal flow of traffic.
B. 
Issuance; application; description. Any person seeking permission to park a vehicle in front of his or her private driveway, shall complete an application form to be provided by the Longport Police Department, which application shall conform with the requirements of N.J.S.A. 39:4-138.4 and 39:4-138.5. Upon acceptance of the application and approval of the issuance of the permit by the Longport Police Department in accordance with N.J.S.A. 39:4-138.4 and 39:4-138.5, the Longport Police Department shall issue such permit to the person.
C. 
Fees. The Borough of Longport shall not charge a fee in connection with the application for or issuance of the permit. However, a fee of $50 will be required for replacement of any lost or stolen permit.
D. 
Term. Permits shall be valid from July 1 to June 30 of each year. All permits must be renewed between June 1 and June 30. Any permit issued shall automatically expire upon the sale of any home.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule 1 (§ 161-13) attached to and made a part of this chapter.

No person shall park a vehicle between May 15 and September 15 upon any of the streets or parts thereof described in Schedule 1A (§ 161-13.1) attached to and made a part of this chapter. The Chief of Police, in his discretion, may establish exceptions to this parking section as he deems necessary for commercial and/or construction vehicles. Such exceptions are to be for temporary parking only during permitted work hours. The Chief of Police shall set forth any exceptions to this section in a directive and provide a copy of the same to the Borough Administrator.
No person shall park a vehicle for longer than the time limit shown in Schedule 2 at any time upon any of the streets or parts of streets described in Schedule 2 (§ 161-14) attached to and made a part of this chapter. Vehicles shall be parked only at angles as designated in Schedule 2.

The streets or parts of streets described in Schedule 2A (§ 161-14.1) are hereby designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles.

In addition to the penalty imposed for the violation of any of the provisions of this article of any vehicles parked in violation of any of the provisions of this article, the Police Department may cause said vehicles to be removed to such place as designated by the Chief of Police. The owner or operator of such vehicle so removed shall pay the reasonable cost and expense of such removal and the storage which may result therefrom, and any person, firm or corporation desiring to reclaim such vehicle may do so by paying the expenses of such removal, storage and violation.

As used in this article, the following terms shall have the meanings indicated:
RESTRICTED VEHICLE
Any motor vehicle, which exceeds 1,200 cubic feet in size, or eight feet or greater in height, measured as follows:
A. 
Length: from the outside of the front bumper to the outside of the rear bumper.
B. 
Width: from one sidewall to the other, measured at the widest point.
C. 
Height: from the street to the topmost point of the vehicle (including ladder racks and other equipage but not including radio antennas) and with tires fully inflated.

Restricted vehicles defined in this Article II shall be prohibited from parking on private or public property in order to carry out the objectives of the Master Plan of the Borough of Longport, specifically, to maximize the amount of on-street parking available to lessen congestion in the streets; to provide adequate air, light, circulation and open space on public and private properties; to provide for the maximum possible enhancement and preservation of the visual and aesthetic quality of the environment; and to regulate the temporary overcoverage of lot area and misuse of side areas and other open spaces in violation of the objectives of the Master Plan.

All restricted vehicles shall be prohibited from parking anywhere in the Borough of Longport on private property, public property or public rights-of-way, at any time, except as follows:
A. 
Restricted vehicles which have been continuously parked as of February 1, 2002, in a manner that would be in violation of the provisions of this section had it been effective on that date may continue to be parked in the same particular manner for a period of three years following the effective date of this section, subject to the following limitations and conditions:

(1) 
The five-year grace period shall not be construed to be a property right, shall not run with the land, and shall be personal to the operator of the vehicle. The grace period cannot be sold or transferred in any manner whatsoever.
(2) 
The five-year grace period applies only to the actual vehicle and manner of parking giving rise to the grace period, and not to any change in manner of parking. However, the original vehicle subject to the grace period may be replaced with another of the same or smaller type and size, provided a gasoline-fueled vehicle shall not be replaced with a diesel-fueled one. Vehicle substitution shall not extend the original five-year grace period.
(3) 
All vehicles subject to the five-year grace period shall be registered with the Chief of Police of the Borough of Longport. Registration shall require sufficient proof that the vehicle is entitled to the grace period.
(4) 
The terms and conditions of the five-year grace period shall be strictly construed. The public interest is to phase out vehicles subject to the grace period as quickly as possible.
B. 
Any restricted vehicle may be serviced at a legal service station, so long as said vehicle does not obstruct access by other vehicles into or within the site or sight lines along streets and at intersections. All parts of restricted vehicles being serviced must be off of the public right-of-way. Outdoor storage at service stations shall be limited to 72 hours. Restricted vehicles may be parked in said service stations only for servicing and for no other reason.
C. 
Any restricted vehicle may be parked within a legal, totally enclosed garage structure.
D. 
Restricted vehicles providing delivery of goods or services may be parked in legal parking spaces only for the purpose of providing the service or delivery of goods and only as long as is necessary to complete the service or delivery but not before 7:00 a.m. or after 7:00 p.m. This includes vehicle parking of local business establishments during the normal business day on the street in a legal space.
E. 
Restricted vehicles owned by a particular legal commercial business establishment in the commercial district of the Borough may park off street, in a legal off-street parking space of the particular business establishment to which the vehicle belongs.
F. 
Public bus company vehicles are excepted from the restrictions hereof within legal turnaround areas and waiting zones.
G. 
Police, fire and other municipal vehicles, as well as county, state and federal vehicles and vehicles of other public bodies and utility companies, shall be exempted from restrictions hereof, provided they are fulfilling legitimate governmental or public functions.
H. 
Any restricted vehicle may park on the public street near the home of the owner for no more than four hours in any twenty-four-hour period for personal reasons but not for repair, changing oil, cleaning, washing, waxing or servicing said vehicle.
I. 
Recreational vehicles, including campers, house trailers and mobile homes, shall not be permitted to park in the Borough of Longport, except licensed and registered vehicles may be parked in legal on-street parking areas between the hours of 6:00 a.m. and 10:00 p.m. However, parking between the hours of 10:00 p.m. and 6:00 a.m. shall be permitted for no more than six forty-eight-continuous hours in any ninety-day period for the sole purpose of allowing the operator to load, unload and prepare for travel. Under no circumstances shall any of the above-mentioned recreational vehicles be occupied or used for any purpose other than over-the-road use.
J. 
Notwithstanding anything contained herein to the contrary, restricted vehicles used for moving in and out of residences and commercial establishments shall be permitted for up to a seventy-two-hour continuous period, to park in a legal off-site parking space or a proper on-site parking space.

In addition to any other penalties herein provided, any person violating any of the provisions of this Article II shall, upon conviction thereof by the Municipal Court, be punishable by a fine of not less than $20 nor more than $50 for each violation. Each violation shall be considered a separate and distinct violation punishable as aforesaid.

The streets or parts of streets described in Schedule 8 (§ 161-20) are hereby designated as loading zones, and no person shall park a vehicle during the times indicated other than for the loading or unloading of goods and materials.

A. 
Notwithstanding any contrary provisions in Chapter 161, and elsewhere in the Borough ordinances, limited parking shall be permitted in those certain areas described in Article IX, of § 161-13, attached to and made a part of this chapter. The said parking exceptions designated in Article IX shall be limited to parking of vehicles on the days and hours during which scheduled activities (including Lifeguard meetings) are conducted for the Longport Community Club House and churches. Discretionary additional exceptions for limited parking no later than 11:00 p.m. may be approved by consent of both the Chief of Police and one Borough Commissioner, subject to conditions as may be imposed at their sole discretion.
B. 
The following seasonal and/or time limited exceptions are noted for municipal use only:

A. 
Discretionary parking within established parking areas limited to municipal vehicles only may be approved and regulated through written consent of both the Longport Chief of Police and at least one Borough Commissioner.
B. 
The Borough shall establish designated employee-only parking spaces behind Borough Hall for exclusive use by Borough employees between the hours of 9:00 a.m. and 5:00 p.m., Monday through Friday. Employees entitled to such parking will be issued an identification placard or sticker for their vehicle. The employee-only parking spaces shall be identified by signage indicating parking for employees only. Any vehicle parked in an employee-only designated spot without an identification placard or sticker is subject to penalties as set forth in the provisions of Article II of this chapter. The Borough Commissioners shall set the number of employee-only parking spaces by resolution. The Chief of Police, in consultation with the Borough Administrator, shall identify the spaces behind Borough Hall to be designated for employee-only parking.
