A certain document, three copies of which are on file in the office of the Clerk of Margate City, being marked and designated as "The BOCA National Property Maintenance Code, Fifth Edition, 1996," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Property Maintenance Code of the City of Margate, in the State of New Jersey, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Property Maintenance Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 215-3 of this chapter.
All ordinances or parts of ordinances inconsistent with this chapter are hereby repealed.
That the BOCA National Property Maintenance Code is amended and revised in the following respects:
A.
In Section PM-100.l (page 1, second line), the following shall be inserted: "City of Margate City."
B.
In Section PM-109.2 (page 7, third line), the following amounts shall be inserted: "$25" and then "$1,000."
C.
In Section PM-109.2 (page 7, fourth line), the following shall be inserted: "30 days."
D.
In Section PM-302.12 (page 17, first line.), the following dates shall be inserted: "May 15 to October 15."
E.
In Section PM-601.1 (page 27, tenth line), the following dates shall be inserted: "October 1 to May 1."
F.
In Section PM-601.2 (page 27, second line), the following dates shall be inserted: "October 1 to May 1."
G.
Section PM-6O2.1.1, Receptacles, is amended to add as follows:
(l)
Bathroom receptacles shall have ground-fault circuit-interrupter protection for personnel.
(2)
All one-hundred-twenty-five-volt, single-phase, fifteen- and twenty-ampere receptacles within six feet of a kitchen sink to serve kitchen counter top surfaces shall have ground-fault circuit-interrupter protection for personnel. Exception: receptacles serving refrigerators and freezers that are not readily accessible. Readily accessible receptacles serving refrigerators and freezers shall be a single receptacle.
(3)
At least one twenty-ampere duplex receptacle shall be installed to serve any kitchen counter top space wider than 12 inches.
(4)
All outdoor, basement and garage receptacles shall comply with 1990 NEC 210-8.
H.
Section PM-602.l.2, Lighting fixtures, is amended to add as follows:
(l)
At least one wall-switch-controlled lighting outlet shall be installed at every outdoor entrance or exit.
(2)
Fixtures in clothes closets shall comply with 1990 NEC 410-8.
I.
Section PM-603.0, Elevators, Escalators and Dumbwaiters, is hereby deleted.

J.
Section PM-302.10, Handrails and guardrails, first sentence, is amended to read as follows:
PM-302.10, Handrails and guardrails: Every flight of stairs which contains three or more risers shall have a handrail on at least one side of the stairs, and every open portion of the stairs, landing or balcony which is more than 30 inches (762 millimeters) above the floor or grade below shall have guardrails.
K.
Section PM-302.10.1 is added as follows:
PM-302.10.1 Guards: Guards shall be designed so as not to allow a six-inch sphere to pass through.
L.
Section PM-403.3, Area for sleeping purposes, is amended as follows:
PM-403.3 Area for sleeping purposes: All square footage shall be 70 square feet.
M.
In Section PM-302.12, Insect screens, the following dates shall be inserted in the first line: "April 1 to October 30."
N.
Section PM-303.9 is hereby added as follows:
PM-303.9 Guards: Guards shall be designed so as not to allow a six-inch sphere to pass through.
O.
Section P.M. 607.0, Carbon monoxide detectors, is added as follows:

P.M. 607.1 General: All homes rented or sold within the City of Margate shall be required to have carbon monoxide detectors, manufactured, listed and labeled in accordance with UL 2034 and installed in accordance with the requirements of N.F.P.A. 720.
P.M. 607.2 Installation: Carbon monoxide detectors shall be installed in accordance with the manufacturer's suggested installation instructions.
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired to existing, under any act or ordinance hereby repealed as cited in § 215-2 of this chapter, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
