are derived from Ch. 14, Art. 4, of the former Revised Ordinances,
adopted 11-21-1972 by Ord. No. 639.
A system for the collection, removal and disposal
of ashes, rubbish and garbage is hereby established, the cost thereof
to be paid by general taxation. The Mayor and Council may, from time
to time, establish a schedule for such collections.

A.
Residential. Residential premises receiving municipal solid waste
collection services shall comply with the following regulations:
(1)
Garbage collection shall be provided only from private receptacles,
each of which shall weigh not more than 60 pounds, and shall have
a volume not in excess of 1 1/2 cubic yards.
(2)
Garbage shall be collected only from the curbside immediately adjacent
to the residential premises from which the garbage is being collected.
(3)
No person shall put or place any garbage at the curbside prior to
6:00 p.m. on the day next preceding the scheduled collection day.
Garbage receptacles shall be removed from the curb no later than 7:00
p.m. on the day of collection.
(4)
Collection of garbage shall not be required in excess of a total
weight of 120 pounds per residential unit served.
B.
Commercial.
(1)
Commercial premises receiving municipal solid waste collection services
shall comply with the following regulations:
(a)
Curbside Garbage.

Collection shall be provided only from private receptacles,

a volume not in excess of 1 1/2 cubic yards and shall be collected
only from the curbside immediately adjacent to the residential premises
from which the garbage is being collected.

No person shall put or place any garbage at the curbside prior
to 6:00 p.m. on the day next preceding the scheduled collection day.
Garbage receptacles shall be removed from the curb no later than 7:00
p.m. on the day of collection.
(b)
Dumpster Collection.

Collection shall be provided only from receptacles provided
by the municipality or its vendor or private receptacles shall be
of a design and size as approved by the municipality.

The municipality shall approve of the location of the dumpster.
[3]
The property owner shall maintain the dumpster in a neat, healthy
and odor-free manner.
(2)
Commercial premises receiving solid waste collection services from
a private vendor shall comply with the following regulations:
(a)
Private collection shall not occur during the hours of 8:00
p.m. and 6:30 a.m.
(b)
The location of private garbage receptacles must be approved
by the Borough.
(c)
Any truck used for the collection and transportation of solid
waste shall have a watertight body and be so protected on the top
that no solid waste or other refuse shall be blown or dropped from
the truck. The solid waste and other refuse carried in the truck shall
be confined within its permanent body construction. Such trucks shall
be kept covered at all times except during the period of filling or
emptying.
(d)
Any solid waste or other refuse which spills or is dropped or
blown from a truck either during collection or transportation shall
be swept or cleaned up immediately so as not to leave any such matter
upon the streets or premises within the Borough.
(e)
All containers or receptacles emptied during the course of the
collection of solid waste or other refuse matter shall be returned
to the locations from which they were removed during the course of
collection.
(f)
In addition to compliance with the foregoing requirements, any
person engaged in the collection or disposal of solid waste and other
refuse matter within the Borough shall comply with all state statutes,
codes and regulations and all municipal ordinances and regulations
concerning the collection and disposal of such materials.

Residential premises receiving municipal solid
waste collection services shall comply with the following regulations:
A.
Ashes and rubbish shall be collected only from the
curbside immediately adjacent to the residential premises from which
the garbage is being collected.
B.
No person shall put or place any ashes or rubbish
at the curbside prior to 6:00 p.m. on the day next preceding the scheduled
collection day. Ash and rubbish receptacles shall be removed from
the curb no later than 7:00 p.m. on the day of collection.
C.
Ashes and rubbish shall be either placed in authorized
private receptacles or securely tied or bundled in bundles not weighing
more than 60 pounds nor with a volume in excess of two cubic yards
or a length in excess of four feet.
D.
The total weight of ashes and rubbish to be collected
from any premises shall not exceed 500 pounds per unit served during
any regular collection.
E.
Owners or occupants of premises within the Borough of Maywood or their representatives who are not regularly engaged in the landscaping business are required to bag leaves in compostable paper bags or in a reusable container without lid and set at curbside for collection in accordance with § 256-10 of the Borough Code.
F.
No persons shall sweep or deposit leaves into any
gutter or public street.
A.
The removal of debris and other building materials
resulting from construction of new buildings or alteration of existing
buildings shall be the responsibility of the contractor, property
owner and/or homeowner, and no such debris shall be placed at the
curbside for collection. Contractors and property owners/homeowners
shall share mutual responsibility in being prosecuted for violations
under this chapter.

B.
At their own expense, commercial landscape companies,
tree experts, tree surgeons, arborists or tree contractors, gardeners,
landscapers and horticulturists shall be required to remove all trimmings,
branches, brush, trees, stumps and other waste materials resulting
from the services performed by them from the premises which they service;
but they shall not be required to remove leaves and grass clippings
unless contracted to do so by the owner or occupier of the premises
upon which the services are performed.

Any person who violates any provision of this
chapter shall, upon conviction thereof, be subject to a fine not exceeding
$1,000 or to imprisonment for a term not exceeding 90 days, or both.
