Words and phrases used in this chapter shall
be defined in accordance with N.J.S.A. 39:1-1 as amended, and definitions
contained in said statutes shall govern the meaning of said words
and phrases as used in this chapter.
Unless otherwise provided by New Jersey law,
any person who violates any provision of this chapter shall, upon
conviction thereof, be punished by a fine of not less than $10 nor
more than $500 or by imprisonment not exceeding 15 days, or both.
The provision of this chapter imposing a time
limit on parking shall not relieve any person of the duty to observe
other and more restrictive provisions prohibiting or limiting the
stopping, standing or parking of vehicles as set forth in N.J.S.A.
39:4-138, any other New Jersey statute or as hereinafter provided.
Wherever parallel or angle parking is permitted,
all vehicles must park in areas designated by painted lines.
No person shall park any vehicle at any time

A.
The Police
Department shall designate by suitable signs parking spaces along
West Pleasant Avenue as "Reserved for Handicapped Parking," which
spaces are hereby designated as restricted parking spaces for use
by persons who have been issued special vehicle identification cards
by the Division of Motor Vehicles. No other persons shall park or
permit the parking of any other vehicle in said spaces.
B.
The Police
Department shall designate, by the posting of suitable signs, spaces
along Grant Avenue adjacent to Memorial School, east side, as "Reserved
for Handicapped Standing," which spaces are hereby designated as restricted
standing spaces for use by persons who have been issued special vehicle
identification cards by the Division of Motor Vehicles to drop off
and pick up students. No other persons shall stand, park or permit
the parking or standing of any other vehicle in said spaces.

A.
The Mayor
and Council shall designate by suitable signs parking spaces as "Electric
Vehicle Charging Only - 2 Hour Limit - Parking While Not Connected
To Charging Equipment Is A Parking Infraction Pursuant To Borough
Ordinance § 312-7.2” which spaces are hereby designated
as restricted parking spaces for use only by persons who are actively
charging an electric vehicle for a period of time not to exceed two
hours. No other persons shall park or permit the parking of any other
vehicle in said spaces.
No person shall park or leave standing any vehicle
on any street or any municipal parking lot for any of the following
purposes:

Repair of the vehicle, except for emergency repairs.

A.
Upon the declaration of an emergency, there shall
be no parking upon streets or sections of streets where temporary
EMERGENCY NO PARKING signs are displayed.
B.
The Chief of Police, or in his absence the ranking
police officer, is authorized to declare an emergency and to direct
the posting of said EMERGENCY NO PARKING signs when weather conditions,
accidents, fires or public celebrations dictate or require the avoidance
of hazards or other conditions which interfere with the free flow
of traffic.
C.
Notification that the EMERGENCY NO PARKING signs are
being or will be posted shall be given to the operator or owner of
any vehicle which has been parked prior to the posting of the signs.

Entrances and exits from parking lots are designated
as follows:
A.
Bergen Town Center (formerly Bergen Mall Shopping
Center).
(1)
The driveway located on the north side of West Spring
Valley Avenue, 100 feet west of the westerly curbline of Wyoming Avenue,
is hereby designated as both an entrance and a right-hand-turn-only
exit.
(2)
The driveway located on the north side of West Spring
Valley Avenue opposite Lincoln Avenue is hereby eliminated.
(3)
The driveway located on the north side of West Spring
Valley Avenue opposite Edel Avenue is hereby designated as both an
entrance and a right-hand-turn- and left-hand-turn-only exit, subject
to the installation and operation of a traffic signal at the intersection
of Edel Avenue and West Spring Valley Avenue.
(4)
The driveway located on the north side of East Spring
Valley Avenue, 25 feet west of the westerly curbline of Paterson Avenue,
is hereby designated as an entrance only.
The following provisions are made for the impounding
and towing of vehicles violating the provisions of this chapter:
A.
Vehicles deemed nuisances. Any vehicle parked or standing
in violation of this chapter shall be deemed a nuisance and a menace
to safe and proper regulation of traffic and parking regulations as
promulgated by this chapter.
B.
Removal of vehicle; notice of removal; costs of removal.
(1)
Any member of the Police Department may provide for
the removal of such vehicle to a garage or other place designated
by resolution of the Council or by directive of the Chief of Police.
(2)
As soon as practical after the vehicle has been removed,
the Police Department shall give notice thereof to the registered
owner by personal service or by certified mail addressed to said owner
at his last known address.
(3)
Any vehicle removed hereunder shall be retained and impounded until released as provided in Subsection C hereof, and the owner shall pay the cost of such removal together with any storage charge accrued for each day said vehicle is retained and impounded. Payment shall be made directly to the person or business entity who removed and/or stored the vehicle.
C.
Release of impounded vehicles.
(1)
Any vehicle impounded by a member of the Police Department
for any reason shall be released only to the owner thereof or the
agent of such owner and in accordance with release procedures established
by directive of the Chief of Police, which procedure shall require
that a member of the Maywood Police Department approve the release
from impound.
(2)
Any person who releases or takes a vehicle impounded
by the Police Department by any means other than official Police Department
release procedure shall be held in violation of this section.
A.
No person shall park or permit the parking of any
vehicle within a municipal parking lot except in accordance with these
general regulations and such other regulations as may be specified
herein for each particular municipal parking lot.
B.
All vehicles must be parked between the painted lines
designating the parking space.
C.
Except for borough employees, borough officials or
other persons on official borough business, no person shall park or
permit the parking of any vehicle within a municipal parking lot between
the hours of 2:00 a.m. and 7:00 a.m., unless such person has rented
a parking space as hereinafter provided.
D.
No person shall park or permit the parking of any
unauthorized vehicle in any parking space reserved for use by certain
designated Borough employees and officials as hereinafter provided
and appropriately designated by signs.
E.
No person shall park or permit the parking of any
vehicle in parking spaces designated for monthly rental as hereinafter
provided and appropriately designated by signs, unless such person
has rented a parking space as hereinafter provided.
F.
Any person renting a parking space or spaces from
the Borough of Maywood as hereinafter provided shall utilize only
those spaces assigned to them. The Borough assumes no risk or liability
for damages to any vehicle parked in any Borough parking lot, whether
parked lawfully or unlawfully. The Borough makes no representations
or warrants that it will protect or care for any vehicle so parked,
and in all instances, such parking shall be at the owner's risk.
G.
All parking spaces shall be rented on a twenty-four-hour
basis at a fee as set forth by the Mayor and Council.
H.
Any person desiring to rent space on a monthly basis
shall apply to the Police Department for such permission to park and
the Department is authorized to rent such space on a monthly basis.
The Police Department shall keep a record of the number of spaces
rented and fees collected.
I.
Except as herein provided, no person shall park or
permit the parking, standing, storing or operation of any vehicle
on any Borough property or lands, which has been posted as hereafter
set forth, without the prior consent of the Chief of Police or officer
in charge in the event of the absence of the Chief of Police. All
property owned by the Borough of Maywood shall be posted with signs
advising the public that the property belongs to the Borough of Maywood
and that the parking, standing, storing or operation of a motor vehicle
on the property is a violation of this subsection, except when permission
has been obtained from the Chief of Police.

A.
The parking lot located on the northeasterly corner
of Park Avenue and Maywood Avenue, generally known as the "Public
Safety Parking Lot," is hereby designated as a municipally operated
parking area.
B.
The Police Department shall designate by suitable
signs two parking spaces for thirty-minute parking time limited, between
the hours of 9:00 a.m. and 4:30 p.m., Monday through Friday, to be
reserved for parking by visitors to the John A. Steuert, Jr., Municipal
Complex.
C.
The Police Department shall designate such number
of unmarked parking spaces as may be appropriate to be reserved for
parking by official police vehicles only, at all times. The Chief
of Police or his designee may authorize other vehicles to park in
these spaces when necessary.
A.
The parking lot located on the northerly side of Park
Avenue on the easterly side of the Public Safety Building and firehouse
property, commonly known as the "Park Avenue Firehouse Parking Lot,"
is hereby designated as a municipally operated parking area.
B.
The Police Department shall designate by suitable
signs certain parking spaces in said lot to be reserved for parking
by members of the First Aid and Emergency Squad and the Fire Department
only, at all times.
A.
The parking lot located on the southerly side of West
Hunter Avenue and immediately adjacent easterly to the firehouse,
commonly known as the "West Hunter Avenue Firehouse Parking Lot,"
is hereby designated as a municipally operated parking area.
B.
Parking spaces in said lot shall be reserved for parking
by members of the Fire Department only, at all times.
A.
The parking lot located adjacent to 459 Maywood Avenue,
commonly known as the "Maywood Public Library Parking Lot," is hereby
designated as a municipally operated parking area.
B.

(1)
During hours when the Library is open to the public,
parking spaces shall be limited to employees and patrons of the Maywood
Public Library.
(2)
When the Library is not otherwise open to the public,
general parking shall be permitted, provided that no person shall
park any vehicle in any of the parking spaces for longer than two
hours, between the hours of 8:00 a.m. and 10:00 p.m., except on Sundays
or public holidays.
(3)
Between the hours of 8:00 p.m. and 10:00 a.m., parking
shall be permitted only by vehicle owners who have obtained a permit
issued by the Borough for this purpose, the fee for which shall be
as set forth in the most recent fee ordinance of the Borough of Maywood.

C.
The Police Department shall designate by suitable
signs two parking spaces immediately adjacent to the Municipal Library
Building as "Reserved for Handicapped Parking," which spaces are hereby
designated as restricted parking spaces for use by persons who have
been issued special vehicle identification cards by the Division of
Motor Vehicles or the temporary cards issued by the Chief of Police.
No other persons shall park or permit the parking of any other vehicle
in said spaces.
E.
Designated entrances.

F.
No stopping or standing. There shall be no stopping
or standing permitted in any driveway area of the library unless specifically
designated and marked as to allow parking.
A.
In accordance with the request of the Board of Trustees
of the Maywood Senior Citizens Housing Corporation, a not-for-profit
corporation incorporated under Title 15 of the New Jersey Statutes
Annotated, Subtitle I of Title 39 of the New Jersey Statutes Annotated
is hereby made applicable to the parking lot located adjacent to the
premises known as "150 East Passaic Street," and commonly known as
the "Lydecker Manor Parking Lot."
B.
No persons shall park or permit the parking of a vehicle
in the location designated with appropriate signs as a "loading zone"
for any purpose other than loading or unloading.
C.
No persons shall park or permit the parking of any
vehicle at any time in and along any part of the curb area of the
Lydecker Manor Parking Lot or the driveway leading to and from the
parking lot, except where properly marked parking spaces are provided.
D.
No persons shall park or permit the parking of visitors'
vehicles at any time in any area of the parking lot other than those
designated by signs for visitor parking.
E.
The parking spaces designated for handicapped parking
are hereby designated as restricted parking spaces for use by persons
who have been issued special vehicle identification cards by the Division
of Motor Vehicles or the temporary cards issued by the Chief of Police.
No other persons shall park or permit the parking of any other vehicle
in said spaces.
F.
All vehicles must be parked between the painted lines
designating the parking spaces.
G.
The parking lot and driveways are hereby designated
as one way in an easterly direction from Golf Avenue to The Esplanade.
H.
The intersection of the driveway leading from the
parking lot and The Esplanade is hereby designated as a stop intersection.
A.
The property situated on the northeasterly corner
of East Passaic Street and Maywood Avenue, generally known as the
"Borough Hall Annex Parking Lot," is hereby designated as a municipally
operated parking area.
B.
The parking area within this lot shall provide a maximum
of 25 parking spaces for passenger automobiles only.

A.
The parking lot on Spencer Joseph Way shall be designated
as the “Spencer Joseph Way Parking Lot” and is hereby
designated as a municipally operated parking area.
B.
The parking area within the lot shall be divided into
a maximum of 50 parking spaces for passenger automobiles only.
C.
General parking shall be permitted, provided that
no person shall park any vehicle in any of the parking spaces for
longer than three hours, between the hours of 8:00 a.m. and 9:00 p.m.,
except on Sundays or public holidays.

D.
Thirteen parking spaces shall be designated for general
overnight parking. Between the hours of 10:00 p.m. and 8:00 a.m.,
parking shall be permitted only by vehicle owners who have obtained
a permit issued by the Borough for this purpose, the fee for which
shall be as set forth in the most recent fee ordinance of the Borough
of Maywood.
A.
The parking lot located on the northwest corner of
Palmer Avenue at the intersection of West Fairmount Avenue, commonly
known as the "West Fairmount Avenue Parking Lot," is hereby designated
as a municipally operated parking area.
B.
The parking area on the easterly perimeter of the
lot shall be marked into 16 reserved parking spaces available for
monthly rental for passenger automobiles only.

A.
The parking lot located along the northerly side of
West Pleasant Avenue between Maywood Avenue and Oak Avenue, known
as 27 West Pleasant Avenue, also known and designated as Lot 37 in
Block 61 as shown on the Tax Map of the Borough of Maywood, is hereby
designed as the "West Pleasant Avenue Parking Lot" and is designated
as a municipally operated parking area.
B.
Parking regulations.
(1)
General parking shall be permitted, provided
that no person shall park any vehicle in any of the parking spaces
for longer than three hours, between the hours of 8:00 a.m. and 9:00
p.m., except on Sundays.

Between the hours of 10:00 p.m. and 8:00 a.m.,
parking shall be permitted only by vehicle owners who have obtained
a permit issued by the Borough for this purpose, the fee for which
shall be as set forth in the most recent fee ordinance of the Borough
of Maywood.
A.
The property owned by the Borough and commonly referred
to as "Memorial Park" shall have parking areas on the east side of
Spring Valley Road, which areas shall be designated as municipally
operated parking areas.
B.
The entrance to said parking areas shall be through
the south driveway and the exit from said areas shall be through the
north driveway.
C.
There shall be no parking in said lot between the
closing hour of Memorial Park and 7:00 a.m.
D.
Only authorized vehicles shall be permitted within
the confines of Memorial Park. Person(s) having need to take their
vehicle into the park may only do so with the express consent of the
Police Department.
E.
All vehicles, with the exception of Department of
Public Works vehicles and emergency service vehicles, shall remain
on the dirt road that runs between the north and south sections of
Wyoming Avenue.
F.
The parking spaces designated for handicapped parking
are hereby designated as restricted parking spaces for use by persons
who have been issued special vehicle identification cards by the Division
of Motor Vehicles or the temporary cards issued by the Chief of Police.
No other persons shall park or permit parking of any other vehicle
in said spaces.

A.
The property owned by the Borough and commonly referred to as "Municipal
Swim Pool" shall have parking areas on the east side of the lot adjacent
to Duvier Place, which area shall be designated as municipally operated
parking area.
B.
Parking regulations.
(1)
During hours when the Swim Pool is open to the public, parking
spaces shall be limited to employees and patrons of the Maywood Municipal
Swim Pool.
(2)
When the Swim Pool is not otherwise open to the public, general
parking shall be permitted.
(3)
Between the hours of 8:00 p.m. and 10:00 a.m., parking shall
be permitted only by vehicle owners who have obtained a permit issued
by the Borough for this purpose, the fee for which shall be as set
forth in the most recent fee ordinance of the Borough of Maywood.

A.
It shall be unlawful to park or leave unattended standing
any vehicle in the public streets or highways within the limits of
the Borough of Maywood during a snow or ice storm after snow or ice
has fallen so as to cover the public streets and highways within the
Borough of Maywood, and such prohibition shall continue until such
streets or highways shall be cleared of snow and/or ice.
B.
Due notice of the provisions of this section shall
be given to the public, as provided by N.J.S.A. 39:4-198, by the placing
of signs on all streets or highways entering the Borough of Maywood
with words to the effect and to include: NO PARKING WHEN STREETS ARE
SNOW COVERED.
C.
Any vehicle parked or standing in violation of this
section shall be deemed a nuisance and a menace to the safe and proper
regulation of traffic, and any peace officer at any time or such Road
Department member designated from time to time by the Superintendent
of Roads during snow removal and emergencies may provide for the removal
of such vehicles. The owner shall pay the reasonable costs of removal
and storage which may result from such removal before regaining possession
of the vehicle.
All ordinances or parts thereof inconsistent
herewith are hereby repealed to the extent of such inconsistencies.
Said repeal shall include but is not limited to Borough of Maywood
Ordinance Nos. 536, 539, 559, 571, 598, 632, 641, 669, 673, 686 and
695.
If any section, clause, sentence or other part
of this chapter or the application thereof to any person or circumstance
shall be for any reason adjudged by a court of competent jurisdiction
to be invalid, said judgment shall not affect, impair or invalidate
the remainder of this chapter.
This chapter shall take effect immediately upon
passage and publication as required by law and upon approval by the
New Jersey Commissioner of Transportation[1] and the Board of Chosen Freeholders of the County of Bergen.
