Borough of Middlesex, NJ Chapter 26 Board, Committee, and Commission Meeting Attendance

§ 26-1 Responsibility of board, commission, or committee members; attendance requirement.

A. All individuals appointed to serve on a Borough of Middlesex board, commission or committee for a specified term, with or without compensation, shall regularly attend the regularly scheduled meetings of that body in each calendar year and faithfully discharge their duties and responsibilities by state statute or Borough Code.

B. A member who fails to attend the regularly scheduled meetings for a period of six consecutive weeks or for three consecutive regular meetings, whichever shall be of longer duration, within their term of office without being excused pursuant to § 26-2, may be subject to removal and such office being deemed vacant for the remainder of the member’s term.

C. Notwithstanding the foregoing, this chapter shall not be applicable to the Borough of Middlesex Joint Land Use Board.

§ 26-2 Excused absence.

An absence from any regularly scheduled meeting shall be considered as an "excused absence" when approved by a majority of the members of the board, committee or commission. An absence shall be deemed as excused when that absence occurs as a result of a legitimate illness. The board, committee or commission may refuse to excuse any other absence that is not the result of a legitimate illness.

§ 26-3 Notification to appointing authority; vacancy.

The board, committee or commission shall notify the appointing authority, in writing, when a determination has been made that a member has failed to meet the attendance requirement prescribed in § 26-1. Upon such notification, the office shall be deemed vacant. Such removal shall be effectuated and vacancy shall be filled in the manner(s) prescribed by law.
