As used in this chapter, the following terms shall have the meanings indicated:
BOAT
Include sail boat, surfboard, wind surfer, inflatable boat, raft, sailfish, sunfish, row boat, canoe, dinghy and all other aquatic vessels.
RECREATION AREA
All that certain abandoned street or road owned by the Village known as Cove Landing Road having an area of 0.390 acres located between the mean high-water mark of Oyster Bay Harbor and Oyster Bay Cove Road in the Incorporated Village of Oyster Bay Cove.
VEHICLES
Passenger automobiles or trucks not exceeding a load capacity of 1/2 ton.
An annual license permitting the holder thereof and other members of his household to enter upon the lands and use the facilities of the recreation area shall be issued to qualified applicants therefor by the Village Clerk or any other person(s) designated by the Board of Trustees after submission of satisfactory proof that such applicants are entitled thereto as provided for herein. The Board of Trustees shall by regulation have the power to limit the number of licenses issued so as to prevent overcrowding of the beach.

An individual may store a boat in the recreation area upon obtaining a storage permit from the Village Street Commissioner. This storage permit shall be valid for a one-year period that commences April 1. The permit shall display the year of issuance and the boat rack number assigned. The permit shall be affixed to the bow of the boat or other appropriate location as directed by the Village Street Commissioner.
A. 
The following persons are entitled to use the recreation area:
(1) 
Any person owning real property within the Village of Oyster Bay Cove.
(2) 
Any person who is a bona fide resident of the Village of Oyster Bay Cove.
(3) 
Any person in possession of and legally occupying a private dwelling within the Village of Oyster Bay Cove under written lease of a term of not less than one month.
B. 
Guests shall be permitted the use of the recreation area while accompanied by a licensed person or a member of his household upon payment of such fees and upon such other terms as may be prescribed from time to time by regulation of the Board of Trustees.

A fee shall be collected for each license in the amount prescribed from time to time by regulation of the Board of Trustees.
A. 
A tag or sticker shall be issued to each licensee upon the issuance of a license which when affixed to a vehicle shall permit such vehicle to use the parking facilities provided at the recreation area. Additional tags and stickers may be issued to licensees for use upon other vehicles upon such terms as may be determined from time to time by the Board of Trustees.
B. 
No person shall park any trailer in the recreation area.
C. 
Vehicles shall be parked in an angle pattern and only in areas designated for parking by the Village Police Department and Village Street Commissioner.
D. 
No vehicle of an authorized guest shall be parked at the recreation area unless prior approval has been obtained from the Village Police Department.
The Board of Trustees shall by regulation determine the months, days and hours in which the recreation area shall be open for use by licensees. No use of the recreation area for any purpose shall be permitted except when officially open as herein provided.
The Village will not be responsible for loss, damage or theft to vehicles and their contents or to private property.

A. 
Only boats or other aquatic vessels bearing storage permits shall be stored, kept or secured on the assigned racks in the recreation area. The keeping or storage of such boats in any other portion of the recreation area or in the area adjacent thereto between high- and low-water mark is strictly prohibited.
B. 
A boat not stored in the assigned rack or improperly stored in a rack in the recreation area shall be in violation of this chapter and be subject to impoundment by the Village of Oyster Bay Cove police.
C. 
The recreation area shall not be used for any commercial activity or in connection with any business enterprise.
D. 
Consumption of beer, wine or other alcoholic beverages within the recreation area is strictly prohibited.
E. 
There shall be no launching by trailer of boats or other vessels in the recreation area between the hours of 9:00 a.m. to 6:00 p.m. unless supervised by a recreation area attendant, the Village Street Commissioner or a member of the Village Police Department.
F. 
No person shall kindle, build, maintain or use a fire or any stove using any combustible fuel within the recreation area.

A. 
If a boat has been impounded, the owner shall be notified verbally or in writing, by certified mail, return receipt requested, if his identity and whereabouts can be determined after reasonable efforts. The owner may retrieve an impounded boat upon the payment of the impound fees and all storage costs.
B. 
If a boat remains unclaimed for 90 days, the Village may seek to have the boat deemed to be abandoned property and disposed of in accordance with the provisions of applicable New York State Law.
No person shall solicit contributions for any purpose. No person shall post, distribute, cast or leave about any bills, placards, tickets, handbills, circulars or advertisements or any other matter for advertising purposes.
No person shall hawk or peddle any produce, wares or merchandise within the recreation area.
No person shall leave, throw, lay, drop or discharge into or on the recreation area any tin cans, bottles, refuse, garbage, rubbish or waste. Papers, cartons or any other type of litter must be placed in receptacles for that purpose. Littering is strictly forbidden.
No person shall deface, injure, displace, remove, fill in, raise, destroy or tamper with any drive, path or walk; take up, remove or carry away trees, shrubs, turf or any material or substance; remove or destroy any structure, building or part thereof connected with the recreation area or any other property or equipment, real or personal, owned by the Incorporated Village of Oyster Bay Cove, or under the jurisdiction and control of the Board of Trustees.
Every person using the recreation area shall conduct himself in an orderly manner and shall endeavor to cause no discomfort, annoyance or inconvenience to any other person.
The Board of Trustees is hereby granted the power to promulgate such reasonable rules and regulations, from time to time, as it may determine for the administration and enforcement of this chapter, such regulations to be made public by posting in a conspicuous place in or about the recreation area and filed with the Village Clerk for inspection by licensees during regular business hours.
Any person found in violation of any of the above provisions or the rules and regulations adopted hereunder shall be punishable by the revocation of license to use the recreation area and in addition thereto said violation shall also be an offense against the provisions of this Code.
