Pursuant to N.J.S.A. 40:55D-7 et seq., there is hereby established in and for the Borough of Hasbrouck Heights an Environmental and Transportation Advisory Commission, the membership and duties of which shall be as hereafter provided.
A. 
The Commission shall consist of seven members appointed by the Mayor with the advice and consent of the governing body. One member shall be a member of the Planning Board, and all members shall be residents of the Borough of Hasbrouck Heights.
B. 
All members shall serve without compensation.
C. 
The Commission shall designate one of its members to serve as Chairman and presiding officer.
D. 
Terms.
(1) 
The terms of the office of the first Commissioners shall be as designated by the Mayor in making his appointments as follows:
(a) 
Two members for a term expiring December 31, 2002.
(b) 
Two members for a term expiring December 31, 2003.
(c) 
Three members for a term expiring December 31, 2004.
(2) 
Their successors shall be appointed for terms of three years. None of the members shall be reappointed to membership for more than one successive term after having served one term or any part thereof.
E. 
The governing body may remove any member of the Commission for cause, on written charges served upon the member and after the hearing thereon at which the member shall be entitled to be heard in person or by counsel.
F. 
A vacancy on the Commission occurring otherwise than expiration of a term shall be filled for the unexpired term in the same manner as an original appointment.

The Commission is established to advise the Mayor and Council and the Planning Board in respect to the protection, development or use of natural resources, including water resources, located within territorial limits of the Borough of Hasbrouck Heights. The Commission shall have power to conduct research into the use and possible use of the open land areas of the municipality. With the assistance of current Borough personnel, it shall compile and maintain an index of all environmentally sensitive open areas, publicly or privately owned, including open marshland, swamps and other wetlands, and public transportation facilities, which index shall be kept on file in the office of the Borough Clerk and the Construction Office, in order to obtain information on the proper use of such areas and facilities. The Commission may from time to time recommend to the Planning Board plans and programs for inclusion in the Master Plan and in respect to applications for the development of environmentally sensitive property and the development of any other property in relation to existing and proposed public transportation facilities. The Commission shall advise the Planning Board in respect to the development of such areas and facilities when called upon by that Board to do so.
The Commission may, from time to time as it deems appropriate, recommend to the governing body the acquisition of property.
The Commission shall keep records of its meetings and activities and make an annual report to the governing body.

The Commission shall have power to study and make recommendations concerning open space preservation, water resources management, air pollution control, solid waste management, noise control, soil and landscape protection, environmental appearance, marine resources, protection of flora and fauna, the relationship of proposed land development to existing and proposed public transportation facilities and the improvement of existing transportation facilities and the need for new such facilities and all matters related thereto.
