There is hereby created and established, in and for the Borough of Hasbrouck Heights, a Fire Marshals' Auxiliary, to serve as a separate branch of the Borough Fire Department. The Fire Marshals' Auxiliary shall be subject to the supervision of the Fire Commissioner, Deputy Fire Commissioner and Fire Chief in the same manner and to the same extent as all other branches of the Borough Fire Department.
In order to qualify for membership in the Fire Marshals' Auxiliary, the following minimum requirements shall be met by each applicant:
A. 
The applicant shall be a former member of the Borough Fire Department.
B. 
The applicant may also be the Coordinator, the Deputy Coordinator or any member of the Emergency Management Office operations staff of the Borough of Hasbrouck Heights so long as such person qualifies in respect to the residency requirements imposed upon membership in the Fire Department of the Borough of Hasbrouck Heights.

C. 
The applicant shall be a resident of the Borough of Hasbrouck Heights.
D. 
The applicant shall be of good moral character and shall be physically sound. In the event that the applicant shall have been out of active service in the Borough Fire Department for a period of more than two years prior to application for membership in the Fire Marshals' Auxiliary, such applicant shall take and successfully pass a physical examination performed on behalf of the Borough. Upon attaining the age of 70 years, an applicant or a member shall be required to take and pass a physical examination upon request by the Fire Commissioner, Deputy Commissioner or the Chief of the Fire Department.
Applications for membership to the Fire Marshals' Auxiliary shall be received, processed and considered in the same form and manner as established by ordinance for membership in the Borough Fire Department.[1] Initial applications for membership resulting from the creation of the Fire Marshals' Auxiliary by this article shall be received by the Chief of the Fire Department and, upon his recommendation, forwarded to the governing body for final approval or disapproval.

The Fire Marshals' Auxiliary shall have the primary duty and responsibility of supplementing the members of the regular Borough Fire Department; provided however, that no active firefighting shall be permitted at any time. In supplementing the regular Fire Department, the Fire Marshals' Auxiliary shall, at the direction of the Chief of the Fire Department, perform traffic- and crowd-control functions, pack hose, pick up hose, pack equipment, open hydrants, line in the truck and such other duties as the Chief, in his discretion, may direct.
A. 
Except as set forth below, the Fire Marshals' Auxiliary shall have the same structure and be entitled to the same privileges as are established for the regular Borough Fire Department by the terms and provisions of Borough Ordinance No. 249,[1] as amended and supplemented, including the power to elect its own officers and to adopt its own rules, regulations and bylaws.

B. 
The following shall serve as limitations on such structure expressly applicable to the Fire Marshals' Auxiliary:
(1) 
Members of the Fire Marshals' Auxiliary shall be nonvoting members of the Borough Fire Department and shall not participate in regular Fire Department elections.
(2) 
The Fire Marshals' Auxiliary shall serve without compensation or clothing allowance to be paid by the Borough, except that this subsection shall not be construed to affect the provision of appropriate insurance coverage on behalf of the members of the Fire Marshals' Auxiliary.
