As used in this article, the following terms shall have the meanings indicated:
COMPOSTABLE LEAF AND GRASS REFUSE
Grass clippings, weeds, garden, plant and vegetable cuttings and leaves or a mixture thereof purely of organic matter and subject to decay.

Within the limitations hereinafter established, the Borough of Hasbrouck Heights will provide collection of such compostable leaf and grass refuse generated from all residential premises within its boundaries according to such schedule as may be hereafter established by regulation adopted in accordance herewith, except such compostable leaf and grass refuse as may be gathered up from such premises by a commercial enterprise which shall be required to remove that refuse itself, unless such refuse is left by the commercial enterprise with the property owner for disposal by the property owner in accordance with the terms hereof.
A. 
From January 1 to August 31 of any year, such compostable leaf and grass refuse will be collected when placed in either bags or containers on the curb in front of such premises, all in accordance with the terms of Article I of this chapter, as the same has been amended and supplemented, and in accordance with the rules and regulations adopted thereunder in the same manner and with the same restrictions and requirements as those ordinances and rules and regulations apply to garden refuse.
B. 
From September 1 to December 31 of any year, collection of such compostable leaf and grass refuse shall be in accordance with Subsection A hereof, except that such compostable leaf and grass refuse shall be collected only if it is contained in biodegradable bags.
C. 
From October 10 to December 10 of any year, collection of such compostable leaf and grass refuse shall be collected in accordance with Subsections A and B hereof, except that such compostable leaf and grass refuse may, if the property owner chooses, be left unbagged in the roadway in front of the premises from which it is collected and immediately adjacent to the curb.
The Mayor and Council may, by resolution, establish additional rules and regulations in respect to the matters contained herein in the same manner as provided in § 152-6 of this chapter.

It shall be unlawful for any person, firm or corporation to deposit or place any leaf or grass refuse into the solid waste stream for collection or disposal as solid waste.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be subject to such penalties as are provided in Chapter 204 of this Code. In fixing the fine provided under Chapter 204, the court shall consider the additional or extraordinary cost to the Borough resulting from the violation of the terms of this article, as such cost may be certified to the court by the Superintendent of Public Works.
