There shall be hereby established the sole and exclusive system for the deposit of certain compostable refuse upon the recycling and resource-recovery site of the Borough of Hasbrouck Heights.

The Superintendent of the Department of Public Works shall designate an area within the grounds of the Department of Public Works upon which certain compostable refuse shall be deposited, and no dumping of such materials shall hereafter be permitted except upon that location and in accordance herewith. No person, firm or corporation shall be permitted to deposit materials in accordance herewith until issued a permit by the Superintendent of the Department of Public Works for such purposes. The annual fee for such permit shall be as set forth in Chapter 133, Fees. The issuance of such permit may be denied or such permit may be revoked after issuance upon a determination by the Superintendent that the applicant or permittee does not qualify under the terms of this article or has failed to comply therewith.
A. 
The Superintendent is hereby authorized to issue tickets to permittees for the deposit of materials, in accordance herewith, and to charge a fee therefor as set forth in Chapter 133, Fees. Each such ticket shall entitle the permittee and holder thereof to deposit in accordance therewith one respective truckload of materials upon surrender of that ticket as follows: one pickup truck ticket, one mason dump truck ticket, or one rack-type truck ticket. For the purpose hereof, each such load shall not exceed a volume of material loaded higher than the standard nonmodified, cargo-area sidewalls of each such type of truck. All such types of tickets shall be sold in books of 20.

The holder of such ticket may thereupon, between the hours fixed herein, present such ticket to the Superintendent or his designee, who shall determine that the holder qualifies hereunder and who shall determine that the refuse that the holder proposes to deposit is of the nature herein specified. If the ticket holder is found unqualified or if the refuse is of a nature other than that permitted hereunder to be deposited, the ticket holder shall be denied the privilege to deposit.
No materials shall be deposited upon the recycling and resource-recovery site except such materials as the Superintendent of the Department of Public Works shall reasonably determine to be compostable, and such material shall be chopped, cut, graded or otherwise reduced to a size no greater than one cubic inch per unit. It shall be the responsibility of any person, firm or corporation depositing such materials, in accordance herewith, to spread over such material powdered lime at a rate of 25 pounds for each cubic yard deposited at the time of such deposit.
No person, firm or corporation shall be permitted to deposit refuse unless such refuse is the product of business within the Borough of Hasbrouck Heights. In order to verify such fact, the Superintendent of the Department of Public Works may, as he deems reasonably necessary, examine the records of any permittee and may prohibit such deposit in the event that he determines that more than 10% of his refuse may be the product of business conducted outside the Borough of Hasbrouck Heights or in the event that such person, firm or corporation refuses to permit the examination of its records upon the reasonable request of said Superintendent. The Superintendent may further require any permittee to file with him a certification of the names and addresses of clients served within the Borough of Hasbrouck Heights and a statement of the type and approximate volume of the refuse anticipated to be removed from such premises and shall deny or revoke the permit should fewer than 90% of the properties serviced be located in the Borough of Hasbrouck Heights.
No person, firm or corporation shall deposit such refuse upon said recycling and resource-recovery site except between the hours of 2:00 p.m. and 3:00 p.m. on Monday through Friday of any week, exclusive of such holidays on which the Department of Public Works is closed.
No person, firm or corporation shall deposit such refuse except in accordance with the reasonable regulations imposed by the Superintendent of the Department of Public Works after notification of such regulations.
Any person, firm or corporation to whom or to which a ticket is issued hereunder shall be required to comply with any other law, rule or regulation relating to the deposit of refuse, including but not limited to the completion of such forms as may be required by any federal, state, county or municipal agency having jurisdiction over the deposit of such refuse or over such recycling and resource-recovery sites. Any person, firm or corporation failing or refusing to comply with such laws, rules or regulations shall be prohibited from depositing refuse.

Any person, firm or corporation found guilty of failing to comply with the provisions of this article or any of the reasonable requirements or regulations formed hereunder by the Superintendent of the Department of Public Works of the Borough of Hasbrouck Heights shall be subject to such penalties as are provided in Chapter 204 of this Code.
