GENERAL REFERENCES

No person, firm or corporation shall remove or otherwise dispose of any earth or soil from any premises within the Borough of Hasbrouck Heights where the same may be except and unless he shall apply for and obtain a license or permit so to do from the Superintendent of the Department of Public Works.
A. 
Said license or permit shall be issued on the written application of the owner of said premises, which shall set forth a sketch or drawing of the premises as to which such application is made, the purpose of such proposed removal, the place of disposal and the approximate quantity of earth or soil to be removed.
B. 
The Public Works Superintendent shall be authorized to refuse the permit for such removal if it appears, in his judgment, that said removal will be harmful to the appearance or contour of the premises from which it is proposed to be removed or interferes with the stability or drainage of said premises or of any adjacent premises.

C. 
A license fee as set forth in Chapter 133, Fees, per cubic yard removed shall be collected. The Superintendent of Public Works shall be authorized to waive the collection of such permit fees as to any and all earth or soil removed to such public property at such point as may be designated by the Superintendent of Public Works in the Borough.

Any person, firm or corporation who removes or otherwise causes to be removed or disposes of any earth or soil within the Borough of Hasbrouck Heights other than as herein provided for or who in any manner whatsoever violates any of the other terms or provisions of this chapter shall be subject to such penalties as are provided in Chapter 204 of this Code.
