No person, firm or corporation shall construct, operate, maintain or use any swimming pool or other pool adaptable for use for swimming or bathing constructed or being above or below the grade of the surrounding premises except in accordance with the terms and provisions of this chapter.[1]

A. 
Such pool shall be completely enclosed and surrounded by a fence or wall not less than four feet in height located between the property of the pool walkways and the property line. The fence or wall shall be so constructed as not to have openings, holes or gaps larger than four inches in at least one dimension. A dwelling house or accessory building may be used as part of such enclosure. All gates or doors opening through such enclosure shall be equipped with a self-closing or self-latching device for keeping the gate or door securely closed at all times when not in actual use, except that the door of any dwelling house which forms a part of such enclosure need not be so equipped.
B. 
Aboveground pools are exempt from the fencing requirements herein, provided that the top of the pool is at least four feet above the surrounding grade and access ladders and steps are removed or secured when not in uSwimming pools Violations and penalties 240-4Violations and penalties Swimming pools 240-4se.

Each and every pool shall be subject to inspection on the part of the Building Inspector and Police Department of the Borough.[1]
