There is hereby established in the Borough of
Totowa a State Uniform Construction Code enforcing agency to be known
as the "Building Department of the Borough of Totowa."

A.
Said agency shall consist of a Construction Official,
Building Subcode Official, Plumbing Subcode Official, Electrical Official,
Fire Protection Subcode Official and such other subcode officials
for such additional subcodes as the Commissioner of the Department
of Community Affairs, State of New Jersey, shall hereafter adopt as
part of the State Uniform Construction Code.
B.
Said agency shall further consist of an Assistant
Building Subcode Official.
C.
The Construction Official shall be the chief administrator
of the enforcing agency. All appointments shall be for a term of one
year to expire on December 31 of each year or for such longer term
as required by applicable statute.
D.
Each official position created in Subsections A and B hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended,[1] and N.J.A.C. 5:23, provided that, in lieu of any particular
subcode official, an on-site inspection agency may be retained by
contract pursuant to N.J.A.C. 5:23. More than one such official position
may be held by the same person, provided that such person is qualified
pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold each such
position.

A.
Definitions.
(1)
As used in this chapter, the "Building Code of the
Borough of Totowa" shall include and mean the code as set forth in
the latest edition of the Uniform Construction Code of New Jersey.

Whenever the following words, terms or phrases are
used in the latest edition of the Uniform Construction Code of New
Jersey, they shall have the meanings hereinafter given:
The Construction Official, Building Subcode Officials, Plumbing
Subcode Official, Electrical Subcode Official, Fire Protection Subcode
Official and such other subcode officials of the Borough of Totowa.

B.
Adoption of the Building Code of the Borough of Totowa. The whole of the latest edition of the Uniform Construction Code of New Jersey, as defined in § 153-3A(1) are incorporated herein by reference as though they had been set forth at length herein, and three copies of said codes have been placed in and are now on file in the respective offices of the Borough Clerk and subcode officials and shall remain in each office for examination by the public as long as said code is utilized by the Borough of Totowa. The latest edition of the Uniform Construction Code of New Jersey are hereby adopted as the Building Code of the Borough of Totowa.

There is hereby established the following fee
schedule, adopted pursuant to the State Uniform Construction Code
Act (N.J.S.A. 52:27D-119 et seq.) and the New Jersey Administrative
Code (N.J.A.C. 5:23-1.1 et seq.).

The building subcode fee shall be as follows:
A.
New construction. $0.040 per cubic foot of building
volume or a minimum fee of $85.
B.
For additions: $0.045 per cubic foot of building volume
or a minimum fee of $85.
D.
For a project with combinations of renovations and/or
alterations and/or repairs, the fees for permits shall be computed
separately.
E.
Premanufactured structure: $15 per $1,000 of estimated
costs or a minimum fee of $100.
F.
Demolition: The fee for a permit for the demolition
of a residential building or part thereof shall be $200. The fee for
any other building shall be $15 per $1,000 of the estimated cost.
H.
Signs. The fee for a permit to construct a sign shall
be $3 per square foot of surface area of the sign, provided that the
minimum fee shall be $85. In the case of double-faced signs, the area
of the surface of only one side of the sign shall be used for purposes
of the fee computation.
J.
Tents. The fee for tents under 900 square feet shall
be $200. The fee for tents in excess of 900 square feet shall be $300.
K.
Roofing. The fee for roofing and siding work completed
on a residential structure other than a one- or two-family home shall
be $15 per $1,000 or a minimum of $85. For all other structures, the
fee shall be $18 per $1,000 of estimated cost.
L.
Swimming pools. Residential R-5 use, single-family,
two-family houses:
(1)
In-ground pool: $200 minimum or $15 per $1,000 of
estimated cost. Engineering escrow deposit of $350. In the event the
site plan is not approved and must be resubmitted, the applicant will
be charged at the municipal engineer’s hourly rate.
(2)
All other use groups: $300 or $18 per $1,000 of estimated
costs.
(3)
Aboveground pool: $85.
M.
Removal. The fee for a permit for the removal of a
building or structure from one lot to another or to a new location
on the same lot shall be $10 per $1,000 of the sum of the estimated
costs for moving, for a new foundation and the placement in a completed
condition in the new location, or a minimum fee of $100.
N.
Plan review.
(1)
The fee for plan review shall be 20% of the amount
to be charged for a construction permit and shall be paid before the
plans are reviewed. The amount paid for this fee shall be credited
toward the amount of the construction fee to be charged for the permit.
(2)
The fee for an application for a variance shall be
$594 for Class I structures and $120 for Class II and Class III structures
in accordance with N.J.A.C. 5:23-2.10. The fee for resubmission of
an application for a variance shall be $229 for Class I structures
and $65 for Class II and Class III structures.

P.
Retaining walls (not included with site development
for new homes):

A.
The fee
for a one-family dwelling shall be $100.
B.
The fee
for a two-family dwelling shall be $200.
C.
The fee for a certificate of occupancy shall be $50
for buildings up to 5,000 square feet. The fee for buildings over
5,000 square feet shall be $100.
D.
The fee for a certificate of occupancy granted pursuant
to a change of use group shall be $120.
E.
The fee for a certificate of continued occupancy issued
under N.J.A.C. 5:23-2.23(c) shall be $120.
The Construction Official shall, with the advice
of the subcode officials, prepare and submit to the Municipal Council,
biannually, a report recommending a fee schedule based on the operating
expenses of the Building Department and any other expenses of the
municipality fairly attributable to the enforcement of the State Uniform
Construction Code Act.
Pursuant to the provisions of the Uniform Construction
Code, N.J.A.C. 5:23-4.19, State of New Jersey Training Fees, the Borough
shall do the following:
A.
In order to provide for the training and certification
and technical support programs required by the Act, an enforcing agency,
including the Department when acting as the local agency, shall collect
a surcharge fee to be based upon the volume of new construction within
the municipality. Said fee shall be accounted for and forwarded to
the Bureau of Regulatory Affairs in the manner herein provided.
B.
Amount. The fee shall be in the amount of $0.0019
per cubic foot volume of new buildings and additions. The fee for
all other construction, except preengineered systems of commercial
farm building, shall be $0.96 per $1,000 of value of construction.

C.
Remitting and reporting. The municipality shall remit
fees to the Bureau on a quarterly basis, in conjunction with report
Number R-840B, State Training Fee Report, in accordance with N.J.A.C.
5:23-4.5(e). Fees remitted shall be for the quarter. Checks shall
be made payable to Treasurer, State of New Jersey.
