GENERAL REFERENCES
Brush, grass and weeds — See Ch. 45.
Fire prevention — See Ch. 50.
Garbage, rubbish and refuse — See Ch. 84.
No person, without a permit granted by the Fire Chief or his Deputy, shall kindle or maintain any outdoor fire, including the burning of leaves, trash and brush in the Village of Carthage except:
A. 
In a fireplace constructed of noncombustible material.
B. 
In a noncombustible grill designed for cooking foods.
No outdoor fire requiring a permit shall be ignited within 25 feet of any structure or accumulation of combustible material.
No person shall kindle or maintain a fire on the oil- or paved surface of any Village road or sidewalk.
A. 
Permits shall be valid only for the day designated by the Fire Chief or his Deputy.
B. 
Permits may be granted orally and, if requested, confirmed in writing.
C. 
The Fire Chief or his Deputy shall have the right to limit the number of permits issued in any one day according to the season of the year and any other relevant considerations of fire safety.
D. 
Unless specifically excepted in writing, permits shall be valid only during the daylight hours.
E. 
When the Fire Chief or his Deputy determines that conditions exist in which an outdoor fire would constitute a danger to public safety, he may deny an application for a permit and may prohibit any outdoor fires for such period of time as he deems advisable.
F. 
The Fire Chief or his Deputy may cancel a permit when, in his judgment, the public safety is endangered or a traffic hazard exists.
Any person kindling or maintaining a fire under this chapter shall not be relieved of responsibility if the fire escapes or causes personal injury or damage to the property of another.
A. 
No person, firm or corporation shall permit the accumulation of any combustible waste material on any premises after written notice by the Fire Chief or his Deputy that such accumulation constitutes a fire hazard dangerous to public safety.
B. 
If any person, firm or corporation receiving such notice fails to correct the hazardous condition within the time specified in the notice, the issuing authority may have the accumulation removed at the expense of such person, firm or corporation.

Any person committing an offense against any provision of this chapter shall be subject to the penalties set forth in Chapter 5 of this Code.
