The Village of Carthage shall contain, on and after the effective date
of this section, in addition to the territory heretofore contained within
its boundaries, the following described territory:
A.Â
All that certain plot, piece or parcel of land, with
the buildings and improvements thereon erected, situate, lying and being in
the Town of Wilna, Jefferson County, New York, and is part of the 11th western
and 23rd northern ranges of the subdivision of Great Lot No. 5 of MaComb's
Purchase and is bounded as follows: beginning in the center of the St. Lawrence
Turnpike at the northeast corner of 51Â 35/100 acres conveyed to V. Brooks
April 15, 1833, and running thence N 64° W 42 chains 18 links along said
51Â 35/100 acres to a maple cornered and marked J.L. in the northwesterly
line of V. Brooks lot; thence N 26° E 12 chains 25 links to a post and
stones 6 links southeast from a beech tree cornered; thence S 64° E 39
chains 50 links to the center of the turnpike 40 links southeast from a hemlock
post marked J.L.; thence along said center S 22 3/4° W 3 chains 50
links; thence S 7° W 5 chains; thence S 15 1/4° W 4 chains to
the place of beginning, containing 50 acres, be the same more or less. Also
all that other piece or parcel of land, situate in the Town of Wilna, Jefferson
County, New York, and is part of the 11th western and 23rd northern ranges
of Great Lot No. 5 of MaComb's Purchase and bounded as follows: Beginning
in the center of the old St. Lawrence Turnpike Road at the northeast corner
of a lot in possession of the party of the first part (in former deed, Fiesthamel),
21 chains 50 links northeasterly from the northeast corner of 50 acres conveyed
to Thomas Brayton December 13, 1822, and running along said Fitzsimmons lot
N 64° W 39 chains 50 links to a post in the easterly line of land conveyed
to Eli West, 6 links southeasterly from a birch tree cornered and marked J.L.;
thence at right angles N 26° E 6 chains 25 links along said land conveyed
to Eli West to a hemlock tree cornered and marked J.H. in the south line of
land conveyed to L. Cosgrove; thence along said land of Cosgrove and land
conveyed to Michael Cuningham March 8, 1865, S 64° E 41 chains 38 links
to the center of said old Turnpike Road 25 links southeasterly from a post
and stones marked J.H.; thence along the center of said road S 29° W 3
chains 9 links; thence S 50° W 1 chain 30 links; thence S 30° W 1
chain 98 links to the place of beginning, containing 25Â 27/100 acres
of land, be the same more or less. Also all that other tract or parcel of
land, situate in the Town of Wilna, County of Jefferson and State of New York,
and is situated in the 11th and 12th western and 22nd and 23rd northern ranges
in Castorland and bounded as follows: Beginning in the center of the St. Lawrence
Turnpike at the northeast corner of 50 acres of land deeded to Thomas Brayton
December 13, 1822, and running thence N 64° W 59 chains 30 links to a
hemlock post; thence N 27° E 8 chains 75 links to a hemlock post; thence
S 64° E 57 chains 93 links to the center of the turnpike; thence along
said center S 15 1/4° W 6 chains 13 links; thence S 21° E 2 chains
87 links to the place of beginning, containing 51 acres and 35/100 of an acre,
as surveyed May 6, 1820, by Edward Tucker. The above described 51Â 35/100
acres being divided into 2 equal parts by a line running parallel with the
westerly line thereof. Being the same land conveyed by Edward Galvin and wife
to Joseph Crowner on the sixth day of June 1859, and recorded in the Clerk's
office of the County of Jefferson the eighth day of March 1873, in Book No.
196 of Deeds, Page 239 and c. Excepting therefrom the westerly half of said
parcel; excepting and reserving therefrom the following 2 parcels of land,
namely: (1) 3/100 of an acre and (2) 5/100 of an acre as described in a deed
from Henry Guyett and Edith Guyett, his wife, to Jefferson County, dated February
2, 1927, and recorded in the Jefferson County Clerk's office February
3, 1927, in Book 385 of Deeds, at Page 47, to which deed and record thereof
reference is hereby made for a more full description of the 2 parcels hereby
excepted and reserved. Also excepting and reserving therefrom 10 acres of
land heretofore contracted to be sold to Wallace Branagan, and described as
follows: All that tract or parcel of land, situate in the Town of Wilna, County
of Jefferson and State of New York, and bounded and described as follows:
Beginning at a point in the center of the St. Lawrence Turnpike at the northeast
corner of 50 acres of land deeded to Thomas Brayton December 13, 1822, and
running thence N 64° W 15 chains 87 links to a point; thence N 27°
E 6 chains 75 links to a point; thence S 64° E 14 chains 50 links to a
point in the center of said St. Lawrence Turnpike; thence along said center
S 15 1/4° W 4 chains 13 links to an angle; and thence S 21° W
2 chains 87 links to the place of beginning, containing 10 acres of land,
be the same more or less. Also excepting and reserving a parcel of land conveyed
by Spencer W. Feisthamel and wife to Gerald L. Barnett, by deed dated July
13, 1951, and recorded in the Jefferson County Clerk's office on July
16, 1951, in Liber 554 of Deeds, Page 448. Reference is made to said deed
for a more complete description thereof. Also excepting and reserving a grant
to the State of New York for highway purposes, dated May 10, 1957, and recorded
in the Jefferson County Clerk's office on April 1, 1958, in Liber 659
of Deeds, at Page 54. Also excepting and reserving a parcel of land containing
1.10 acres of land conveyed by Spencer W. Feisthamel and wife to Allan St.
Louis and wife by deed dated May 23, 1962, and recorded in the Jefferson County
Clerk's office on May 28, 1962, in Liber 721 of Deeds, at Page 255. Also
excepting and reserving a right-of-way granted by Spencer W. Feisthamel and
wife to Allan St. Louis and wife by deed dated August 14, 1962, and recorded
in the Jefferson County Clerk's office on August 30, 1962, in Liber 726
of Deeds, at Page 292. Being the same premises conveyed by Belle Feisthamel
to Donald Majka and Sally L. Majka by deed dated March 14, 1972, and recorded
in the Jefferson County Clerk's office on March 15, 1972, in Book 835
of Deeds, at Page 386. Also all that other piece or parcel of land situate
in the Town of Wilna, County of Jefferson and State of New York, bounded and
described as follows: Beginning at a point situate on the most westerly margin
of the Carthage-Fargo State Highway, said point being distant 383 feet northerly
along said margin from the most southerly line of premises conveyed by Gerald
L. Barnett to Spencer W. Feisthamel and Belle Feisthamel, by warranty deed
dated July 13, 1951, and recorded in the Jefferson County Clerk's office
on July 16, 1951, in Liber 554 of Deeds, at page 441; running thence N 80°
30' W 210 feet to a point; running thence N 13° 00' E 230 feet
to a point; running thence S 67° 00' E 128 feet to a point; running
thence S 84° 30' E 82 feet to a concrete monument situate on the
most westerly margin of the aforesaid highway; running thence along said westerly
margin S 13° 30' W 145 feet to a concrete monument; and thence S
11° 00' W 60 feet to the place of beginning, containing 1.10 acres
of land, be the same more or less. Being the same premises conveyed by Spencer
W. Feisthamel and Belle Feisthamel to Allan St. Louis and Edna St. Louis by
deed dated May 23, 1962, and recorded May 28, 1962, in Book 721 of Deeds,
at Page 255, in the Jefferson County Clerk's office. Also excepting and
reserving a grant to the State of New York for highway purposes dated May
20, 1958, and recorded in the Jefferson County Clerk's office on August
20, 1958, in Liber 665 of Deeds, at Page 221. Also there is hereby granted
a right-of-way of ingress and egress in and upon and along a driveway approximately
8 feet in width on the north of the parcel herebefore granted to the parties
of the second part. Said driveway is 210 feet in length and shall be used
for the purposes of ingress and egress to the parcel hereinbefore referred
to for access by vehicles and pedestrians. Being the same premises conveyed
by Spencer W. Feisthamel and Belle Feisthamel to Allan St. Louis and Edna
St. Louis by deed dated August 14, 1962, and recorded August 30, 1962, in
Book 726 of Deeds, at Page 292, in the Jefferson County Clerk's office.
Being the same premises conveyed by Allan St. Louis and Edna St. Louis to
Donald Majka and Sally L. Majka by deed dated August 14, 1980, and recorded
in the Jefferson County Clerk's office on September 24, 1980, in Book
910 of Deeds, at Page 241.

All that tract or parcel of land described in an executor's
deed from Jennie C. Galvin and Frank P. Phillips as executors of the Last
Will and Testament of James Galvin, deceased to Mary McNeil, dated September
20, 1911, and recorded in the Jefferson County Clerk's office on October
8, 1920, in Liber 362 of Deeds, at Page 5, as follows: All of the westerly
half of all that certain piece or parcel of land, lying and being in the Town
of Wilna, County of Jefferson and State of New York, and is situate in the
11th and 12th western and 22nd and 23rd northern ranges in Castorland and
bounded as follows: Beginning in the center of the St. Lawrence Turnpike at
the northwardly corner of 50 acres of land deeded to Thomas Broyton on December
13, 1852, and running thence N 64° W 59 chains 30 links to a hemlock post;
thence N 27° E 8 chains 75 links to a hemlock post; thence S 64° E
57 chains 93 links to the center of the turnpike; thence along said center
15 1/4° W 6 chains 13 links; thence S 21° E 2 chains 87 links
to the place of beginning, containing 51Â 35/100 acres as surveyed May
6, 1820, by Edmond Tucker, the above described 51Â 35/100 acres being
divided into 2 equal parts by a line running parallel with the westerly line
thereof. Also all that tract or parcel of land, situate in the Town of Wilna,
County of Jefferson and State of New York, and is part of the 11th and 12th
western and 23rd northern ranges of Castorland and bounded as follows: Beginning
on northeast line of 51.35 as surveyed for Virgil Brooks at the southwest
corner of 50 acres surveyed for John Long and deeded to the Mechanics Fire
Insurance Company of the City of New York a maple tree cornered and marked
J.L. and runs thence along the northeast line of said land of Brooks N 63°
W 6 chains 40 links backsight S 68° E to a hub in the center of the Alexandria
Road 25 links N 68° W from a hemlock post and stones marked E.G.; thence
along the center of said road N 5 1/4° E 14 chains 14 links backsight
S 3 1/4° E to a point 25 links S 77 1/2° W from a hemlock
post marked E.G.J.M.; thence N 77 1/2° E 11 chains 48 links to a
hemlock tree cornered and marked J.H. being the northwest corner of 25.27
acres surveyed for John Hagan and deeded to D.A. Ogden; thence along said
land of Hagan and land of John Long S 24° W 18 chains 50 links backsight
N 26° E to the place of beginning, containing 13 90/100 of an acre
as surveyed by Jason Clark. Excepting and reserving all mines and minerals.
Also all that certain piece of land situate in the Town of Wilna, County of
Jefferson and State of New York, being part of the 11th and 12th western and
22nd and 23rd northern ranges of Castorland and is bounded as follows: Beginning
in the center of the St. Lawrence Turnpike at the northeast corner of C.S.
Quillard lot and running thence along said Quillard's land N 63°
W 67 chains 4 links to a hemlock post marked G.E.S.; thence N 37° E 7
chains 50 links to a hemlock post marked E.S.; thence S 63° E 66 chains
46 links to the center of said turnpike 25 links easterly from a post marked
E.S.; thence along the center of said turnpike S 22 1/2° W 7 chains
50 links to the place of beginning, containing 50 acres and 6/100 of an acre
of land as surveyed by E. Tucker reserving unto the party of the first part
and their heirs forever all mines and minerals with the right to enter upon
said land at any time to dig and take the same away. Also all that certain
piece of land lying and being in the Town of Wilna, County of Jefferson and
State of New York, being part of the 11th and 12th western and 23rd northern
ranges in Castorland and is bounded as follows: Beginning in the center of
the St. Lawrence Turnpike at the northeast corner of 50 acres and 6/100 of
an acre deeded to Henry Edwards, Senior, on the 29th day of August last and
running thence along said Edwards land N 63° W 60 chains to a hemlock
post; thence N 27° E 8 chains 75 links to a hemlock post; thence S 64°
E 59 chains 30 links to the center of said turnpike at a point 50 links easterly
from a post and stones; thence along the center of said turnpike S 23°
W 10 chains to the place of beginning, containing 55Â 77/100 of an acre
as surveyed by E. Tucker, excepting and reserving therefrom 5Â 77/100
of the northwest end to be divided from the residue by a line running N 27°
E and excepting and reserving all mines and minerals. Said premises being
located on the Alexandria Road about 2 miles from the Village of Carthage
and known as the "James Galvin Farm." Excepting and reserving all that tract
or parcel of land conveyed by William O. Adner and Ella H. Adner, his wife,
to Everett Pelkey by 2 certain deeds, both executed September 15, 1931, and
recorded in the Jefferson County Clerk's office on July 13, 1933, in
Liber 407, at Page 129. Being the same premises conveyed to Anna M. Whaling
by Carthage National Exchange Bank by deed dated January 28, 1947, recorded
in the Jefferson County Clerk's office June 26, 1947, in Liber 483 of
Deeds, at Page 68. Excepting and reserving therefrom 2.65 acres of land, more
or less, described in deed from Anna M. Whaling to John E. Cook by deed dated
December 14, 1949, recorded in the Jefferson County Clerk's office December
23, 1949, in Liber 528 of Deeds, at Page 52, and to which said deed and the
record thereof reference is hereby had for a more complete and particular
description. Also hereby grants and releases unto the parties of the second
part, the survivor thereof, his or her heirs, distributees and assigns forever,
an easement upon premises conveyed by Adelbert O. Rarick, as executor of the
Last Will and Testament of Charles Rarick, deceased, to Edith M. Shannon by
deed dated January 9, 1945, recorded in the Jefferson County Clerk's
office January 13, 1945, in Liber 451, Page 166, and being all of the right,
title and interest of the party of the first part herein in and to certain
rights to tap and use water main and to maintain pipeline connected therewith
described in agreement between Edith M. Shannon and Anna M. Whaling, dated
April 25, 1949, recorded in the Jefferson County Clerk's office April
27, 1949, in Book 516 of Deeds, at Page 314, and to which said agreement and
the record thereof reference is hereby had for a more particular description
of said easement. Excepting and reserving therefrom that land previously conveyed
to the Department of Works, State of New York, by notice of acquisition dated
July 28, 1959, and recorded July 28, 1959, in Liber 680 of Deeds, at Page
374. Also excepting and reserving therefrom 1.71 acres of land, more or less,
previously conveyed by Gordon M. Gould, Jr. and Adeline E. Gould to Reuben
J. Chaufty and Pearl T. Chaufty by deed dated November 2, 1961, and recorded
in the Jefferson County Clerk's office on November 3, 1961, in Liber
715 of Deeds, at Page 99, and to which said deed reference is hereby had for
a more complete description. Also excepting and reserving therefrom 1.13 acres
of land, more or less, previously conveyed by Gordon M. Gould, Jr. and Adeline
E. Gould to Ralph H. Sears and Marceline Sears by deed dated June 9, 1967,
and recorded in the Jefferson County Clerk's office on June 14, 1967,
in Liber 797 of Deeds, at Page 543, and to which said deed reference is hereby
had for a more complete description. Also excepting and reserving therefrom
all that portion of the above-described lands lying westerly of Alexandria
Street Road. Being a part of the premises conveyed by Anna M. Whaling to Gordon
M. Gould, Jr. and Adeline E. Gould by warranty deed dated September 12, 1957,
and recorded in the Jefferson County Clerk's office on September 24,
1957, in Liber 652 of Deeds, at Page 122. Gordon M. Gould Jr. died June 20,
1986, leaving no taxable estate.
The territory described in § A149-16 of this Act is hereby annexed to the Village of Carthage pursuant to the provisions of § 714 of the General Municipal Law.
The territory described in § A149-16 of this Act and annexed to the Village of Carthage by this Act shall be included in Election District No. 1 of said Village.
The annexation of the above territory described in § A149-16 of this Act shall become effective immediately upon the filing of this statute with the Secretary of State.
This Act shall take effect immediately.
