[HISTORY: Adopted by the Board of Trustees of the Village of Cazenovia 6-1-1966;

noted where applicable.]
Charges shall be as set from time to time by resolution of the Village
Board of Trustees for:
All foundations must be cement, and charges per square inch shall be
as set from time to time by resolution of the Village Board of Trustees.
A.
No burials will be allowed after November 1 to May 1
except with Board of Trustees or the Cemetery Superintendent's permission.
No monuments will be set from November 1 to May 1. Winter vault interments
must be done by June 1 of following year.
B.
Spring burials. No winter vault interments will be buried
on Saturday or Sunday, regardless if full service or none.
C.
Ashes. All cremations must be buried there will be no
broadcasting on lots allowed.
A.
Lots purchased must be paid for in half at time of purchase,
balance to be paid in six months. Interest at the rate will be charged on
unpaid balance. Single lots must be paid before burial is made.
B.
Deed will be issued only when lots (or lot) is entirely
paid for.
C.
Each lot and grave is sold with perpetual care.
D.
If the deed of a lot is lost or mislaid, the person whose
name appears on the deed must make an affidavit before some person competent
to take acknowledgments, then a duplicate will be issued.
E.
Purchasers of lots or plots are entitled to the perpetual
use of same for the sole purpose of interment and repose of their dead, this
right, and the exercise thereof, being subject to the Rules and Regulations
of the Evergreen Cemetery now in force or that may hereinafter be made with
regard to burials, funerals and removals. It is understood and agreed upon
by purchasers of lots, plots or graves, that in case of any dispute as to
the right of ownership and the exercise of such right in such lot, plot or
grave, the decision of the Board of Trustees must be taken as final.
F.
Under the regulations of the management of the Cemetery,
if the owner of lot dies, making no disposition of his or her lot by will,
the lot of such intestate descends to his or her "heir in law" that is, to
the same persons who, by the laws of the state, would inherit any residue
of his/her estate.
G.
Sale of lots or plots by owners is prohibited.
The Board of Trustees are authorized to purchase lots, plots or grave
spaces from proven rightful owners, the purchase price to be at the prevailing
price when lot or lots were sold by the Board.
Bicycles, motorized bicycles, motorcycles, snowmobiles, recreational
vehicles, skateboards, bipeds, horses and other animals are forbidden in the
cemetery.
The cemetery will open at 7:00 a.m. and close at 3:30 p.m., Monday through
Friday, from May 1 to November 1 when the Superintendent or an authorized
agent of the Village is on duty.

If funerals are deferred from one day to another, the
Superintendent must be notified. The undertaker failing to do so will pay
a fine of $100 for keeping men waiting.
C.
All requests for interments must be made by the morning
of the day preceding the burial.
D.
A concrete vault with one-piece cover is required.
A.
No aboveground vault or crypt is permitted.
B.
Not more than one monument shall be permitted on any
lot or plot; all grave makers must be placed at the end of the grave furthest
from the monument. Any stone place on a grave plot will be placed only under
the direction of the Cemetery Superintendent. All stones must be set in accordance
with previously set stones in that section.
C.
Any new undeveloped section after this date, April 1,
1993, will have a minimum of a six-grave plot to be allowed a family monument.
All other grave markers will be flush with grade, including any corner markers.
D.
No gravestones or marker can be set in a socket or dowel.
It must be one solid stone.
E.
The Superintendent must be contacted and is responsible
for putting in all foundations at the expense of the lot owner, except that
monument dealers may, at their expense and under direction of the Cemetery
Superintendent, install foundations for their own monuments.
F.
Any previously erected mausoleum must be sufficiently
endowed to provide for any damage to replace, repair and/or for whatever may
be needed to keep it in excellent condition for as long as it shall remain
standing.
G.
All trucks and setting equipment must stay on driveways
and paths for erecting monuments, planking must be used when necessary to
cross graves, and will be done under direction of Cemetery Superintendent.
A.
No enclosure or wall terrace will be erected.
B.
Lot owners will not be permitted to alter the established
grade of lot.
C.
The Board reserves the right to lay out and alter such
drives, walks, and reservations as they deem necessary to secure and promote
the general objectives of the cemetery.
D.
Planting of trees and shrubs by the owners of the lots
may be allowed, provided that the trees or shrubs to be planted are approved
of and the location of same designated by the Board or the Cemetery Superintendent.
E.
Any trees, shrubs, plants or flowers standing on any
lot shall, by means of roots, branches or otherwise, become detrimental to
adjacent lots, drives, or walks, or if for any other reason its removal shall
be deemed necessary, the Superintendent shall have the right to remove same
or part thereof as in his judgment may seen best.
F.
No improvements on lots shall be done before consulting
the Cemetery Superintendent or Village authorized agent. Work will receive
prompt attention and will be properly done. Reasonable rates will be charged
for such work. All ordinary work in the care of lots such as mowing and trimming
will be done by the cemetery employees.
G.
Planting on graves will not be permitted. Flower pots,
urns, vases, etc. shall be placed next to the monument or grave marker. The
cemetery reserves the right to remove any planting made in violation of this
rule. No glass containers are allowed.
H.
All persons are strictly forbidden to pick up or cut
flowers, shrubs, etc. in any part of the cemetery without special permission
from the Cemetery Superintendent or Village authorized agent.
I.
As soon as flowers, wreaths, emblems, flags. etc. used
in funerals or placed on graves at other times become unsightly and are faded,
they will be removed, and no responsibility for their protection or maintenance
will be assumed.
J.
All flowers, pots, urns, vases and/or other decoration
left in place on lots after October 1 will be removed, and no responsibility
for their return will be assumed by the cemetery.
