No minor under the age of sixteen (16) years shall, nor shall any parent,
guardian or other adult person having the care and custody of such minor permit
such minor to loiter, idle, wander, stroll or play in or upon any public street,
public place, public building, place of amusement or entertainment, vacant
lot or other unsupervised place between the hours of 10:00 p.m. and 6:00 a.m.
of the following day. However, provisions of this section shall not apply
to any such minor who is accompanied by his or her parent, guardian or other
adult person having the care and custody of such minor or where such minor
is upon an emergency errand or legitimate business directed by his or her
parent, guardian or other adult person having the care and custody of the
minor.

A.Â
Each violation of this chapter shall constitute a separate
offense.
B.Â
The violation of any provision of this chapter by any
minor shall be dealt with in Family Court and according to the Family Court
Act of the State of New York; and pending determination thereof, no minor
shall be incarcerated in any jail, but he or she may be detained in a private
room at police headquarters until the parent, guardian or other adult person
having the control and custody of such minor can be notified.
