Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

§ 7-2 Official time standard.

Whenever certain hours are named in this Chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time as may be in current use in the Borough.

§ 7-3 Parking.

§ 7-3.1 Regulations not exclusive.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

§ 7-3.2 Parking prohibited during state of emergency.

A. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY-NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY-NO PARKING signs when weather conditions, accidents, fires, or public celebration, dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification of the EMERGENCY-NO PARKING signs are being or will be posted and shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
B. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
C. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

§ 7-3.3 Parking prohibited at all times on certain streets.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I attached to and made a part of this chapter.[1]

§ 7-3.4 Parking prohibited during certain hours on certain streets.

No person shall park a vehicle between the hours specified in Schedule II of any day (except Saturdays, Sundays and public holidays) upon any of the streets or parts of streets described in Schedule II attached to and made a part of this chapter.[1]

§ 7-3.5 Stopping or standing prohibited during certain hours on certain streets.

No person shall stop or stand a vehicle between the hours specified in Schedule III of any day (except Saturdays, Sundays and public holidays) upon any of the streets or parts of streets described in Schedule III attached to and made a part of this chapter.[1]

§ 7-3.6 Parking time limited on certain streets.

No person shall park a vehicle for longer than the time limit shown in Schedule IV at any time between the hours listed in Schedule IV of any day (except Saturdays, Sundays and public holidays) upon any of the streets or parts of streets described in Schedule IV attached to and made a part of this chapter.[1]

§ 7-3.7 Alternate side of street parking; limitations on parking.

In order to facilitate snow or leaf removal and the adequate cleaning of streets, no vehicle shall be parked upon the side of any street described in Schedule V attached to and made a part of this chapter.[1] For these purposes, the Borough is divided into areas designated as shown on the map of the Borough of Highland Park attached hereto and made a part of this chapter.
A. 
Area A. Begins at Raritan Avenue at the bank of the Raritan River, running easterly along the center line of Raritan Avenue to the center line of Fourth Avenue; thence southerly along the center line of Fourth Avenue to a point on the bank of the Raritan River; thence in a general westerly and northerly direction along the course of the Raritan River to the point of beginning.
B. 
Area B. Begins at Raritan Avenue on the Bank of the Raritan River, running easterly along the center line of Raritan Avenue to the center line of Fourth Avenue; thence northerly along the center line of Fourth Avenue to the center line of Lincoln Avenue; thence easterly along the center line of Lincoln Avenue to North Fifth Avenue and the boundary line with Edison Township; thence northwesterly along the boundary line of Edison Township to the boundary line of Piscataway Township; thence southwesterly along the boundary line of Piscataway Township to the bank of the Raritan River; thence in a general southeasterly direction along the course of the Raritan River to the point of beginning.
C. 
Area C. Begins at the center line of the intersection of Raritan Avenue and Fourth Avenue; thence easterly along the center line of Raritan Avenue to the center line of Woodbridge Avenue; thence easterly along the center line of Woodbridge Avenue to the Edison Township boundary line; thence southerly along the Edison Township boundary line to a point on the bank of the Raritan River; thence in a general westerly direction along the course of the Raritan River to a point marking the extension of the center line of South Fourth Avenue; thence northerly along the center line of South Fourth Avenue to the point of beginning.
D. 
Area D. Begins at the center line of the intersection of Raritan Avenue and Fourth Avenue; thence easterly along the center line of Raritan Avenue to the boundary line of Edison Township; thence westerly along the boundary line of Edison Township to the center line of Lincoln Avenue; thence along the center line of Lincoln Avenue to the center line of North Fourth Avenue; thence southerly along the center line of North Fourth Avenue to the point of beginning.
E. 
Area E. Begins at a point in the center line of the intersection of Raritan Avenue and Woodbridge Avenue; thence easterly along the center line of Woodbridge Avenue to the boundary line of Edison Township; thence easterly, northerly and westerly along the boundary line of Edison Township to the center line of Raritan Avenue; thence westerly along the center line of Raritan Avenue to the point of beginning.

§ 7-3.8 Parking prohibited during snow removal.

A. 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, no vehicle shall be parked on roadways or portions wherein signs are erected prohibiting parking as described in Schedule VI attached to and made a part of this chapter.[1]

B. 
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
C. 
Upon the declaration of an emergency, there shall be no parking upon streets or parts of streets where temporary "EMERGENCY-NO PARKING" signs are displayed. The Chief of Police, or in his absence the ranking police officer, is authorized to declare an emergency and to direct the posting of the "EMERGENCY-NO PARKING" signs when weather conditions, accidents, fires, or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic.
D. 
Notification that the "EMERGENCY-NO PARKING" signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
E. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed to be a nuisance and a menace to the safe and proper regulation of traffic and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

§ 7-3.9 Parking prohibited during certain hours for street sweeping.

In order to facilitate the adequate sweeping of streets, no vehicle shall be parked between the hours specified on the side of any street described in Schedule XIX, Parking Prohibited During Street Sweeping, attached to and made a part of this chapter.[1]

§ 7-3.10 Prohibited parking; prohibited stopping or standing.

Except when necessary to avoid conflict with other traffic or in compliance with the directions of a traffic or police officer or traffic sign or signal, no operator of a vehicle shall park, stop or stand the vehicle in any of the following places:
A. 
Within 10 feet of a fire hydrant;
B. 
On a crosswalk;
C. 
Within 25 feet of the nearest crosswalk or sideline of a street;
D. 
Within 50 feet of a stop sign as established by § 7-6 of this chapter;
E. 
Within an intersection;
F. 
Within a bus stop as established by § 7-9 of this chapter;
G. 
Outside the lines or markings of a designated parking space, or in such a manner as to be "double parked";
H. 
Within a private driveway and/or parking lot without the consent of the owner;
I. 
Within a designated loading zone as established by § 7-7 of this chapter;
J. 
Within a designated taxi stand as established by § 7-8 of this chapter;
K. 
On the roadway side of any vehicle stopped or parked at the edge or curb of a street.

§ 7-3.11 Handicapped parking.

Pursuant to the authority granted to this municipality by N.J.S.A. 39:4-197, the following locations are hereby designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles. No other person shall be permitted to park in these spaces.

§ 7-3.12 Removal of vehicles.

Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicles. The owner shall pay the reasonable costs of the removal and storage which may result from such removal as established by this Chapter 7 before regaining possession of the vehicle.

§ 7-4 Restricted vehicles.

§ 7-4.1 Weight limitations.

Vehicles over four tons are hereby prohibited from parking, stopping or standing on any street within the Borough of Highland Park except on those streets designated by ordinance as truck routes.

§ 7-4.2 Route for trucks over four tons.

Notwithstanding the provisions of § 7-4.1, and pursuant to the provisions of N.J.S.A. 40:67-16.1, the streets or parts of streets as described in Schedule VII attached to and made a part of this chapter are hereby designated as routes for trucks over four tons.[1]

§ 7-4.3 Commercial vehicles.

Unattached boat trailers, cargo trailers, construction trailers, and recreational trailers are prohibited from parking, stopping or standing on any street within the Borough of Highland Park except as specifically permitted by the Borough ordinance.

§ 7-4.4 Exclusions.

The following vehicles are exempt from complying with this section:
A. 
Borough sanitation vehicles.
B. 
Borough recycling vehicles.
C. 
Borough Fire Department and Rescue Squad vehicles.
D. 
Public utility vehicles.
E. 
Construction vehicles on job sites where authorized or sanctioned by the Borough of Highland Park.

§ 7-5 One-way streets.

The streets or parts of streets described in Schedule VIII attached to and made a part of this chapter are hereby designated as one-way streets in the direction indicated.[1]

§ 7-6 Through streets, stop intersections and yield intersections.

§ 7-6.1 Through streets.

Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule IX attached to and made a part of this chapter are hereby designated as through streets.[1] Stop signs shall be installed on the near right side of each street intersecting the through street except where yield signs having sides 36 inches in length are provided for in the designations.

§ 7-6.2 Stop intersection.

§ 7-6.3 Yield intersections.

Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule XI attached to and made a part of this chapter are hereby designated as yield intersections.[1] Yield signs having sides 36 inches in length shall be installed as provided therein.

In accordance with the provisions of § 7-10.4, a person shall make a right turn only, at any of the locations described in Schedule XX attached to and made a part of this chapter.

§ 7-11 Speed limits.

A. 
The streets or parts of streets described in Schedule XVIII attached to and made a part of this chapter shall have the speed limits designated in such schedule.[1]

B. 
Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits as authorized by the Department of Transportation.

§ 7-12 General prohibitions.

§ 7-12.1 Display of vehicle for sale.

No vehicle shall be parked upon any public street displaying such vehicle for sale.

§ 7-12.2 Vehicle repair or maintenance.

No vehicle shall be greased or repaired upon any public street or Borough owned parking lot or property, except for emergency repairs.

§ 7-12.3 Vehicles used for display or sound advertising.

No vehicle shall be operated or parked upon any public street with display or sound advertising.

§ 7-12.4 No-passing zones.

Passing shall be prohibited along the following streets or parts of streets:

§ 7-13 Violations and penalties.

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this chapter shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both, providing that the penalty for overtime parking shall not be less than $20.

§ 7-14 Repealer.

All former traffic ordinances of the Borough of Highland Park covered in this Traffic Chapter are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Chapter.
