The Town of Cornwall has been directed to enact a mandatory recycling
program in order to comply with the directives of the County of Orange, which
has been ordered to institute a recycling program by the Department of Environmental
Conservation. The Town Board determines that conservation of recyclable materials
is now a necessity in order to conserve our material resources and that the
cost of solid waste disposal is ever increasing while landfill facilities
are rapidly decreasing. The Town Board recognizes that the Town of Cornwall
should participate in recycling as part of a nationwide recognition of the
importance of conservation and good stewardship.
In this chapter, the following words and phrases shall have the meanings
respectively set forth below:
Uncontaminated cardboard boxes, food containers and corrugated boxes.
The solid waste hauler under contract with the town.
All products made from silica or sand, soda, ash and limestone, the
product being transparent or translucent and being used for the packaging
or bottling of various materials, excluding blue glass, ceramic, plate glass,
window glass and light bulbs.
All paper of the type commonly referred to as newsprint and distributed
at slated intervals, having printed thereon news, opinions, advertisements
or other matters of public interest; expressly excluded from "newspapers"
are all magazines which are not distributed as part of newspapers.
Individuals, partnerships, corporations, owners, tenants, lessees
or occupants residing, owning, operating, managing, leasing or occupying any
premises, including residential, business, commercial or industrial, within
the unincorporated area of the town.
Any process by which materials which would otherwise become municipal
solid waste and which may be collected, separated or processed.
Any facility designed and operated solely for receiving, storing,
processing and transferring source-separated recyclable materials as designated
by the Town Board.

Solid waste produced by residential, business, commercial and industrial
generators within the town.
A program for the mandatory separation of the following components in
the waste stream is hereby established in the town: newspaper and clear glass,
cardboard and office paper.

Mandatory separation and collection for residential,
business, commercial and industrial generators. It shall be mandatory for
all persons generating a waste stream from any residence, business, commercial
installation or industrial installation to separate the items set forth below
in a manner described below:

Newspapers shall be bundled separately and secured by
string or twine in bundles not more than 12 inches in height, which said bundles
shall not be fastened by tape, wire or any other material. The newspaper bundles
shall be placed at the curb fronting the location where the newspapers were
generated for pickup by the town's contractor the first Wednesday of
every calendar month, commencing on August 2, 1989, and continuing thereafter.
When placed at curbside for pickup, the newspapers shall not be boxed or placed
within any type of container.

Clear glass with all metal and plastic covers removed
shall be placed in a container and placed at the curb fronting the location
where the clear glass was generated the third Wednesday of every month, commencing
on the 16th day of August 1989, and continuing thereafter.

Mandatory separation and collection for business, commercial
and industrial generators. Cardboard and corrugated material and office paper
shall be flattened and fastened with string or twine in bundles not to exceed
24 inches in height. The bundles shall not be fastened by tape, wire or any
other material. The bundles shall be deposited in recycling drop-off centers
at locations and at times established by Town Board resolution from time to
time.
If the contractor determines that any person shall have failed to comply
with the mandatory source separation of materials in accordance with this
chapter, the contractor shall have the right to decline to pick up any solid
waste from the person, including but not limited to the solid waste which
is mandated by this chapter to be source-separated for recycling.
Any person who shall violate any of the provisions of this chapter shall,
upon conviction, be deemed to have committed an offense against this chapter
and shall be punishable by a fine not exceeding $100. In addition to the above
penalty, the Town Board may also maintain an action or proceeding in the name
of the town to compel compliance with or to restrain by injunction the violation
of the terms of this chapter.
