A. 
The Department may, in addition to all other remedies included in this chapter, make or cause to be made repairs to or renewal of water service pipes if the property owner fails, neglects or refuses to repair or renew such services within three days after receiving notice from the Superintendent. However, notice need not be given to the property owner if the Superintendent of the Water and Sewer Department or the Superintendent's representative determines that an emergency condition exists, in which case the Superintendent or the Superintendent's representative may perform the necessary repairs or retain the appropriate persons or entities to perform the necessary repairs, without providing notice to the property owner. The cost of such repairs or renewals plus 20% for overhead and administration shall be borne by the property owner and shall become a lien on the property.
B. 
Any drain or connection prohibited by § 328-32 shall be corrected to comply with this article within 72 hours of written notice from the Borough or other lawful authority. In the event any user fails to comply with such notice from the Borough, the Borough may proceed to take or cause to be taken corrective action. The cost of such corrective action plus 20% for overhead and administration shall be borne by the property owner and shall become a lien on the property.

The Water and Sewer Department of the Borough is hereby continued, the head of which shall be the Superintendent of the Highland Park Water and Sewer Department. The Superintendent shall be appointed by the Mayor and Council. Such other employees as may be required to effectively operate the department shall be hired as needed.
