The owner or tenant of lands lying within the limits of the Borough of Highland Park shall keep all brush, hedges and other plant life growing within 10 feet of any roadway and within 25 feet of the intersection of two roadways, cut to a height of not more than 2 1/2 feet where it shall be necessary and expedient for the preservation of the public safety within 10 days after notice to cut the same and to provide for the cutting of the same thereafter.

The Police Department and the Code Enforcement Officers are hereby designated as the enforcing agencies under this article. The Police Department and Code Enforcement Officers are hereby authorized to serve the ten-day notice as required under § 368-

If the owner or tenant shall have refused or neglected to remove the same within the time provided, the Chief of Police or the Code Enforcement Officers are hereby authorized to provide for the cutting of the same or signing a complaint in accordance with § 368-13.

In all cases where brush, hedges and other plant life are cut from any lands within the limitations of § 368-9 under the direction of the Chief of Police or Code Enforcement Officers, the Chief or said Officers shall certify the cost to the Borough Council, which Council shall examine the certificate and if found correct shall cause the cost to be charged against the lands, or in the event that such cost is excessive, the reasonable cost thereof to be charged against the lands. The amount so charged shall forthwith become a lien upon such lands and shall be added to and form part of the taxes next to be assessed and levied upon such lands, the same to bear interest at the same rate as other taxes and shall be collected and enforced by the same officers and in the same manner as taxes.
Any person violating any of the provisions of this article shall, upon conviction before the Municipal Judge of the Municipal Court of the Borough be subject to a penalty as established by Chapter 1, General Provisions, Article III, General Penalty.
