This chapter shall be known as the "South Strabane Township Outdoor Fire Burning Ordinance" and is intended to regulate the outdoor burning of trash, leaves, paper and other organic materials. However, these regulations shall not apply to fires used in connection with camping, cooking, picnicking or recreation activities.
A. 
No person or persons shall set or maintain any fire upon any of the streets, sidewalks, alleys or public grounds in the Township of South Strabane or burn or cause to be burned thereon any paper, boxes, rubbish, leaves or other material or substance of any kind.
B. 
In built-up or neighborhood areas, every such outdoor fire shall be built in and confined to a noncombustible container, covered with a screen of 1/2 inch or smaller mesh, or with other suitable noncombustible cover, and shall not be permitted closer than 25 feet to any structure or to any property line; provided, however, that in cases where the owner's lot is less than 50 feet in width, the outdoor fire shall be permitted at or near the midpoint in said lot. Garbage, leaves or materials creating offensive odors or excessive smoke shall not be permitted.
C. 
In rural or farm areas, outdoor fires may be built without such containers, provided that said fire is personally supervised and controlled at all times and completely extinguished prior to relinquishment of personal supervision.
No such fire shall be permitted to burn except on Wednesdays, between the hours of 4:00 p.m. and 8:00 p.m., and Saturdays, between the hours of 12:00 noon and 8:00 p.m.; provided, however, that such fires may be permitted on other days, provided that notice is given and permission granted by the Township Manager after clearance with the Township Fire Department, and provided that such burning shall not be permitted on Sundays and holidays.
Burning of trees not in excess of 12 inches in diameter and brush incidental to the development of land or the construction of buildings[1] is permitted, provided a permit is obtained from the Township upon written application by the developer. Said application shall contain a description of the property to be developed, its area and location. The Township Manager shall make a determination from the facts contained in said application whether the use of a DEP-approved air curtain destructor is required.

Fires shall not contain any garbage, any material made of or coated with rubber, plastic or petroleum-based materials and shall not contain any flammable or combustible liquids.
Any person, firm or corporation who shall violate or fail to conform to any of the provisions of this chapter shall be subject to the penalties provided in § 1-2, Summary proceedings, of the Code of the Township of South Strabane.
