As used in this chapter, the following terms shall have the meanings indicated:
LANDSCAPER and EXCAVATOR
Any person, persons, partnership, firm or corporation engaged in the business of landscaping and/or excavating or moving soil, except that it shall not include individuals residing on the property being tended or family members of the property owners.
It shall be unlawful for any person, persons, firm or corporation to act as a landscaper and/or excavator within the Borough of Saddle River without obtaining a permit to do so from the Borough Clerk. Sticker(s) required to be displayed on all vehicles used in this work shall be issued with the permit. The permit and sticker(s) shall be issued for a period of one calendar year (from January 1 through December 31). The permit shall be based on the information provided in a properly completed application form, which will be available at the Borough Hall during regular hours. A fee as provided in Chapter 134, Licenses and Permits, will be charged for each permit to cover administrative costs. This fee will not be prorated for a portion of the year.

Any landscaper or excavator who violates Borough ordinances, such as those covering (but not limited to these examples) dumping, littering, causing excessive noise or causing damage to roadways or curbing, shall, upon conviction for any of these violations, be required to return his permit for that year to the Borough Clerk and refrain from further work within the Borough until he obtains a new permit for a future year.
Violation of the provisions of this chapter shall be punishable as provided in Chapter 1, General Provisions, Article III, General Penalty.

It shall be the duty of the Police Department to enforce the provisions of this chapter.
