A. 
It shall be a violation of this chapter for any person to smoke or carry lighted cigarettes cigars, cigarillos, pipes, or engage other smoking devices, including but not limited to electronic cigarettes, vape pens, vapors, e-liquids, other legal marijuana derivatives or other substances and the like, upon Village of Munsey Park owned property or property under the control of the Village. This includes parks, sidewalks, recreation areas, playgrounds and all other property owned and/ or controlled by the Village. Such conduct is prohibited except where conspicuously designated "Smoking Permitted."
B. 
Smoking is prohibited within a fifty-foot radius of all entrances to all Village buildings and facilities located within the Village of Munsey Park which are either owned, under the control of the village or leased by the Village of Munsey Park and which are designated as accessible by the public.
C. 
The Village further determines and declares that all Village of Munsey Park owned parks, playgrounds, and recreation areas shall be designated as " Smoke-Free Zones."
D. 
Except as otherwise provided in this code, smoking and/or tobacco use in areas designated as "Smoking Permitted" are not to be considered conduct in violation of this chapter.
Smoking areas may be designated by the Board of Trustees for employees who wish to smoke. Such smoking areas will be clearly marked by a "Smoking Permitted" sign.
Employees are encouraged to present any concerns to their supervisors and may register a complaint with the County Enforcement Officer.
A copy of this policy shall be posted upon the Village Bulletin Board and in each separate building in which Village employees work.
Employees found smoking in nonsmoking areas will be considered in violation of this policy and may be subject to the penalty described by the State Commissioner of Health.
