All lands owned by the Borough that have been designated as parks within the corporate limits of the Borough of Carlisle, Cumberland County, Pennsylvania, are hereby designated as a bird sanctuary.

It shall be unlawful to trap, hunt, shoot or attempt to shoot or molest in any manner any bird, wild fowl or the nests thereof; provided, however, that if starlings, pigeons or similar potentially noxious or unhealthy birds are found to be congregated in such numbers and in a particular locality such as shall constitute a nuisance or a menace to the health or property within the Borough of Carlisle as determined by the Health Officer or designated Borough official, then in such event the Mayor, Chief of Police or other proper officer of the Borough of Carlisle shall take the appropriate steps to destroy said birds in such numbers and in such manner as shall as deemed advisable to eliminate said nuisance or menace.

Anyone violating the provisions of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $600, plus costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for not more than 30 days.
