The provisions of the thirteenth clause of the last will of Blanche B. Coyle, late of the Borough of Chambersburg, deceased, dated 29th day of August 1910, shall be accepted by the Burgess and Town Council of the Borough of Chambersburg, which said clause reads as follows:
XIII. All the rest and residue of my Estate I hereby give and bequeath unto a corporation, which I hereby direct my executor to have organized and incorporated under the name and style of the "Coyle Free Library" to be used by the said corporation in the purchase of a suitable lot of ground in the Borough of Chambersburg, and the erection, furnishing and equipment of a suitable building thereon for the free use of the inhabitants of the Borough of Chambersburg, and such other persons as to the directors of the said corporation shall seem proper, as a library building, forever; said building to be known as the "Coyle Library." The affairs of the corporation shall be directed and controlled by a board of seven directors, to be chosen as follows:
Two members thereof shall consist of my executor, hereinafter named, and one other person to be designated by him, they to hold said office for life, or at their pleasure, and their successors to be chosen forever in the same manner as is set forth in the second clause of this my will; two members thereof to be chosen annually on the first Monday of January of each year by the Burgess and Town Council of the Borough of Chambersburg, and the remaining three members thereof to be chosen annually on the same date by the Chambersburg Afternoon Club, of which I am one of the charter members. This legacy is given upon two conditions:
First, that the Burgess and Town Council of the Borough of Chambersburg shall, within seven months after the probate of this my last will by ordinance duly passed, agree to annually pay a sum not less than one thousand dollars per year, for the maintenance of the hereinbefore mentioned library building, and for the conduct and operation of a free library therein for the use of the inhabitants of the Borough of Chambersburg and such other persons as to the directors of the said library shall seem proper, and shall pursuant to the said agreement pay the said sum from year to year;
Second, that the Chambersburg Afternoon Club shall, within seven months after the probate of this my last will, convey unto the said Coyle Free Library, free of cost, the library which the said club may own, control or conduct, at the time of my death.
The sum of $1,000 shall be appropriated out of moneys of the Borough of Chambersburg for the purposes set forth in § 44-1 hereof, and the same shall be paid in quarterly installments of $250 each, in advance, the first payment to be made when the library building hereinbefore mentioned is ready for occupancy.
