For the purpose of this article, the following
words shall have the following meanings"
A single unit providing complete, independent living facilities
for one or more persons, including permanent provisions for living,
sleeping, eating, cooking and sanitation.
Any person or persons occupying the dwelling unit.
Any person, agent, firm or corporation having a legal or
equitable interest in the property.
An alarm-initiating device that detects visible or invisible
particles of combustion.
On each level in each dwelling unit in the borough
there shall be a minimum of one smoke detector which has received
approval by an independent testing laboratory recognized by the National
Fire Protection Association such as Underwriter's Laboratories, Inc.
(UL).
The smoke detector(s) shall be installed in
all dwelling units within the borough not later than January 1, 1995.
A.
Smoke detectors shall be installed in all newly constructed
dwelling units in accordance with the current edition of the BOCA
National Building Code enforced by the borough.
B.
A minimum of one smoke detector shall be installed
on each level in all existing dwelling units in a place acceptable
to the Building Code Official. It is suggested, but not required,
that smoke detectors in existing dwelling units be installed based
on the requirements of the BOCA National Building Code edition enforced
by the borough.
Any person, partnership, firm or corporation
who or which shall violate any provision of this article shall, upon
conviction thereof, be sentenced to pay a fine of not more than $600
and, in lieu of payment, to imprisonment for a term not to exceed
30 days. Each day that a violation of this article continues shall
constitute a separate offense.
