As used in this chapter, the following terms shall have the meanings indicated:
USED GOODS DEALER
Any person or organization buying or acquiring by consignment personal property of any nature (goods), except for those dealers excluded as set forth in § 280-10 below.
Any used goods dealer conducting business from a fixed location in the Borough of Chambersburg must require a photo identification from any seller of goods or consignor of goods (seller).
The used goods dealer shall give a receipt to the seller which shall include the following information:
A. 
The name and age of the seller.
B. 
The address of the seller.
C. 
The specific photo identification used to identify the seller (for example, the Pennsylvania driver's license number).
D. 
A full and accurate description of the items sold to the used goods dealer, including, if available, brand names, model numbers, serial numbers, inscribed initials, dates, names and any other forms of identification on the goods.
E. 
The price paid or to be paid by the used goods dealer for the goods.
No goods may be sold by the used goods dealer (to others or to the original seller) until 48 hours after giving the receipt for the goods to the Chambersburg Police Department.
The goods held by the used goods dealer shall be made available for inspection by the Chambersburg Police Department upon request during regular business hours.
No used goods dealer shall purchase or acquire by consignment any goods from anyone less than 18 years old without the parent or guardian of the minor being present, and the name of the parent or guardian shall be put on the receipt for the transaction.
The receipts shall be numbered consecutively. The receipt forms shall be provided by the Chambersburg Chief of Police.
A clearly legible copy of each receipt shall be provided to the Chambersburg Police Department within 24 hours of the purchase of any goods by the used goods dealer.
A copy of all receipts shall be retained by the used goods dealer for three years.
This chapter shall not apply to judicial sales or sales by executors or administrators of estates; sales to licensed pawnbrokers; occasional or auction sales of household goods sold from private homes not sold to a used goods dealer; any sales of real estate; any sale of guns to a licensed gun dealer; and sales of clothing, books and furniture or consignment of such items.
Penalty for violation of this chapter shall be up to $300 for each violation. Each day a violation continues after notice to the used goods dealer by the Chambersburg Police Department shall constitute a separate offense.
The above provisions are deemed necessary and in the public interest because of the legislative finding that stolen property is occasionally sold to or consigned to used goods dealers and the controls are necessary to reduce the possibility that stolen property will be sold to used goods dealers and notification to the Chambersburg Police Department increases the chances of apprehending the sellers of stolen property.
