There is hereby established a Shade Tree Commission of the Borough of Denver which shall be composed of five residents of the Borough who shall be appointed by Borough Council and shall serve without compensation. Such Commissioners shall be appointed for staggered terms so that one term expires every year. On the expiration of the term of the Commissioner, a successor shall be appointed by the Borough Council to serve for a term of five years.
The Commission shall have the exclusive custody and control of shade trees in the Borough, and is authorized to plant, remove, maintain and protect shade trees on the streets and highways in the Borough. The Commission may make and enforce regulations for the care and protection of shade trees in the Borough, but no such regulation shall be enforced until it has been approved by Council and enacted as an ordinance.
The Shade Tree Commission shall annually report in full to the Council its transactions and expenses for the last fiscal year of the Borough.
