There shall be appointed annually by the President of the Borough Council, after the expiration of the term of the present incumbents, a member of the Council who shall exercise general supervision of the water system and to whose direction the Director of Public Works shall be subject, except as may be otherwise directed by this chapter.

The Borough Council from time to time shall appoint the Borough Director of Public Works, who shall serve for an indefinite term at the pleasure of the Council. The Director of Public Works, under the direction of the Borough Council shall manage and operate the water system. He shall perform all other duties and may exercise all authority vested in him by the Borough Council and by this or any other ordinance of the Borough.

At each regular meeting of the Borough Council the Director of Public Works shall make a complete report of the work done during the preceding month or period. Said report shall include quantity of water received from springs, quantity of water filtered, quantity of water delivered to distribution system, materials and supplies used, repairs made and such other matters as the Borough Council may from time to time require.

In the event that any leakage, waste of water or unnecessary flow of water comes to the knowledge of or is reported to the Director of Public Works, he shall immediately correct the condition causing the leakage, waste or unnecessary flow in the following manner: If said leakage, waste or unnecessary flow is in a private system and caused by a willful or negligent act of a person or by a defect in the private system, and the consumer whose private system it is refuses to make immediate repairs, the Director of Public Works may shut off the water and discontinue the service to said consumer until the defect is remedied; in the event that the leakage, waste or unnecessary flow occurs to the water system, the Director of Public Works shall take all necessary steps in order to efficiently and in a workmanlike manner repair and correct the condition.

No property shall be connected to the water system until an application for a permit containing all information required by the Borough has been submitted and a permit has been issued by the Borough for such connection. Prior to the issuance of the permit to authorize connection, the property owner shall pay all tapping fees, connection fees, customer facilities fees, administration fees, inspection fees and/or any other fees imposed by the Borough which have been established by ordinance or resolution at the time application for a permit is made.

All connections from the water main to the curb box shall be made in accordance with all applicable rules and regulations of the Borough and shall be inspected and approved by the Director of Public Works or his designee. The Borough may require that connection of individual laterals to the water main be made by Borough employees when, in the discretion of the Director of Public Works, such procedure is required to insure proper connection and to protect the water system. If connection from the water main to the curb box shall be made by Borough employees, the property owner shall pay such connection fees as may be established by the Borough. The property owner shall bear all costs relating to the connection of water main to the curb box when made by the property owner and the costs relating to the connection of the curb box to the private system.

All connections from the curb box to the private system shall be made at the same depth and of the same material as the connection from the water main to the curb box and shall be made under the supervision of the Director of Public Works or his designee. Before any water is turned on and allowed to flow into the private system, the Director of Public Works shall inspect the same and approve the private system and connections. Said approval shall be endorsed on the connection permit herein specified and returned by the consumer to the Director of Public Works, who shall file it with the records pertaining to the water system.

All new water meters shall be supplied by the Borough and shall be installed under the direction of the Director of Public Works, the cost of such installation to be paid by the consumer. All water meters shall be the property of the Borough. After installation, the location of the meter shall not be changed, except by permission of and under the direction of the Director of Public Works.

All water meter repairs shall be made by the Borough at Borough expense, except that a consumer shall be responsible for all repairs to a meter damaged through his negligence or that of his family, agent, tenants, workmen or employees, such charge to be payable in full at the time the consumer's next water bill shall be due and payable.

Every consumer in whose property, either as owner or tenant, a meter is installed shall maintain a passageway to the meter and keep said meter accessible for repair or reading at all times. In the case of breakage, stoppage or other irregularities in the meter, the consumer, in whose premises the meter is located, or his agent, shall immediately report said condition to the Director of Public Works. If the Director of Public Works finds the meter seal broken, or other positive evidence of tampering with the meter, or if a meter fails to register properly, the bill for the period will be estimated from the consumption of a preceding period when water was supplied under similar conditions and correctly measured to the said consumer in whose premises the meter is located and the consumer will be charged for that sum.

Whenever the Borough shall determine that it shall be in a Stage II or Stage III Water Shortage as determined by the Borough Water Shortage Response Plan which has been approved by the Pennsylvania Emergency Management Agency, all consumers of water in the Borough shall be required to comply with the nonessential uses of water banned by such plan. If the Borough shall determine that it shall be in a Stage III Water Shortage, all consumers of water in the Borough shall be required to comply with the Local Water Rationing Plan of the Authority which has been approved by the Pennsylvania Emergency Management Agency.

Whenever the premises of a consumer are to be vacated, either temporarily or permanently, said consumer shall notify the Borough Secretary of the fact of removal before vacating the premises. This section is applied in all cases, whether the consumer himself occupies the premises, or whether a tenant or other person is in possession.

A consumer wishing to discontinue the supply of water during any period shall notify the Borough Secretary. The Public Works Department shall turn the water off at the curb box and a special reading shall be made and billed to the consumer. If water service is discontinued by request, or for nonpayment of water rent, the water will be turned on again only upon payment of a service charge of $25 and upon compliance with § 196-23.

Effective October 1, 1977, and thereafter, each water meter shall be connected to a remote reader which shall be supplied and installed by the Borough under the direction of the Director of Public Works at the expense of the consumer. The purchase price and installation cost of each remote reader shall be as determined from time to time by resolution of the Borough Council.

The responsibility of the Borough on the water service lines is from the water main to and including the curb boxes and for that reason as long as water is piped to any building, the proper officials of the Borough shall at all reasonable times have free access to the curb boxes wherever located, to inspect, repair, replace and shut off the supply of water, if necessary, as hereinbefore provided. Such access shall not be impeded in any manner.
