Editor's Note: This ordinance also superseded former Ch. 35, Smoking Policy, adopted 7-8-1993 by Ord. No. 997, approved 7-8-1993, which regulated smoking in the Borough Municipal Building.
The purpose of this chapter is to protect the public health and to provide for the comfort of all parties by regulating and controlling smoking on all Borough properties, municipal public places and at all municipal public meetings.
As used in this chapter, the following words and phrases shall have the following meanings:
MUNICIPAL PUBLIC MEETING(S)
All meetings open to the public pursuant to the act of July 3, 1986 (P.L. 388, No. 84), known as the "Sunshine Act."
MUNICIPAL PUBLIC PLACE
Any indoor and/or outdoor area owned or operated by a state or local governmental municipality or agency and used by the general public or serving as a place of work for municipal employees, including police officers, or any meeting place for a municipal public body, including but not limited to an office, auditorium, arena, meeting room or public conveyance, library, public park or athletic field.
SMOKING
The carrying by a person of a lighted cigar, cigarette, pipe or other lighted smoking device.
No person shall smoke in an area designated "nonsmoking" in accordance with the terms of this chapter in all municipal public places, during municipal public meetings and in the municipal public parks.
The Code Enforcement Officer of the Borough of Glenolden and/or his agent will enforce this chapter and assist in the implementation of this nonsmoking policy.
Any person who violates the provisions of this chapter shall upon conviction, be subject to a fine and penalty of not more than $300 for each offense. Such fines and penalties shall be collected as like fines or penalties are now collected by law.
