This article is adopted to establish procedures for request to be filed and reviewed by the Township of Hempfield regarding the extension or provision of streetlights to properties situate within the Township; to establish a method of assessing the costs of said streetlights; and to establish a procedure for collection of said street light assessments.
A. 
Any person or persons requesting the installation of streetlights to any property or properties within the Township of Hempfield shall first submit a petition to the Hempfield Township Board of Supervisors, on a form as may be prescribed by said Board, setting forth the following information as to all properties abutting along all roadways in the area proposed for said streetlights:
(1) 
The names of all owners;
(2) 
The precise mailing address of all owners;
(3) 
The deed book reference establishing ownership; and
(4) 
The Tax Map parcel number assigned to each tract.
B. 
Upon receipt of such petition, the Board of Supervisors shall have the same reviewed to determine whether the persons signing said petition are the owners of 70% of the Tax Map parcels in the area to be serviced by said streetlight. In order to determine the percentage of Tax Map parcel owners sign the petition, all owners of a Tax Map parcel must sign the petition.
C. 
Once a petition for the establishment of streetlights has been reviewed, and certified as constituting the required signatures as set forth above, the Board of Supervisors shall obtain from the service provider that will light and illuminate the area to be served a written estimate of the installation expense and monthly service charge for said streetlights. All potentially affected property owners shall then be given notice of the estimated cost and monthly service charge and be afforded a final opportunity to add their names to or remove their names from said petition.
D. 
Upon completion of the foregoing review process, if the Board of Supervisors of Hempfield Township determines that a valid streetlight petition remains, then the Township shall create a Street light District in accordance with the provisions of Section 2002 of the Second Class Township Code.[1]

The Board of Supervisors of Hempfield Township is hereby authorized to contract with electric, gas or other lighting companies to light and illuminate roads and highways and other public places with electric light, gas light or other illuminating substances.
The Board of Supervisors, at its sole discretion, shall determine by resolution the manner by which the cost of construction and installation of said street lights shall be collected from those properties served by said streetlights. Said assessment shall be determined by any one or a combination of the methods provided for by Section 2003 of the Second Class Township Code[1] as the same may from time to time be amended.

All annual assessments for streetlights shall be filed with the Township Tax Collector under Section 3301(a) of the Second Class Township Code.[1] The assessment shall be billed on the annual real estate tax bill for general township purposes.
