No person shall operate a motor vehicle upon
any sidewalk in the Township of Hempfield; nor shall any person operate
a motor vehicle upon or across any sidewalk except in order to gain
access to or egress from a driveway or alley at such locations where
the curb, if such sidewalk is curbed, shall have been properly cut
down for the purpose. Any person who shall violate any provision of
this section shall, upon conviction thereof, be sentenced to pay a
fine of not more than $50 and costs of prosecution, and in default
of payment of such fine and costs, to undergo imprisonment for not
more than 10 days.
A.
On all Township roads in an area zoned residential,
the speed limit is 25 miles per hour.
B.
Any person who shall operate a motor vehicle at a
speed in excess of that established therefor upon any highway or portion
thereof specified in this section shall, upon conviction thereof,
be sentenced to pay a fine of $10 and costs of prosecution, and in
default of payment of such fine and costs, to undergo imprisonment
for not more than five days.

A.
The speed limit on Forbes Trail Road from its intersection with Old
Route 66 to its intersection with Peters Road is hereby established
at 25 miles per hour.
B.
The aforesaid speed limit shall not become effective until official
traffic control devices giving notice of the speed limit are erected
upon or at the entrances to Forbes Trail Road at its intersection
with Old Route 66 and its intersection with Peters Road.

B.
Any operator of a vehicle who shall fail to come to
a full stop, within a reasonable distance, before entering any such
stop intersection, as hereinabove required, shall, upon conviction
thereof, be sentenced to pay a fine of $5 and costs of prosecution
and, in default of payment of such fine and costs, to undergo imprisonment
for not more than three days.
A.
The following intersections are hereby established
as yield-right-of-way intersections, and official yield signs shall
be erected (or are hereby ratified if heretofore erected) in such
a position as to face traffic approaching the second-named highway
from the first-named highway, in the direction or directions hereby
indicated. All motor vehicles approaching any such intersection upon
the first-named highway, in the direction or directions hereby indicated,
shall yield the right-of-way to any vehicle in the intersection or
approaching on the second-named highway so closely as to constitute
an immediate hazard during the time that the operator of such motor
vehicle is moving across or within such intersection:

B.
Any operator of a motor vehicle who shall fail to

A.
It shall be unlawful for any person to operate any
motor vehicle except a passenger vehicle (but not including any passenger
vehicle drawing any trailer or towing any other vehicle) upon any
of the following portions of the highways in the Township:

B.
Any person who shall violate any provision of this
section shall, upon conviction thereof, be sentenced to pay a fine
of not more than $50 and costs of prosecution, and in default of payment
of such fine and costs, to undergo imprisonment for not more than
10 days; provided that nothing herein shall prohibit the operation
of any commercial motor vehicle upon any highway or portion thereof
listed hereinabove where such operation thereon shall be necessary
in order to pick up or deliver any goods, wares, merchandise or material
from or to any premises located upon any such highway or portion thereof.

A.
Vehicle weight and size limit restrictions upon the
highways or sections of highways of Hempfield Township shall be adopted
and imposed upon motion, duly seconded and passed by the Board of
Supervisors of Hempfield Township. Said motion shall state therein
whether the restriction imposed is determined to be necessary to prevent
the damage or destruction of said roads or sections thereof or bridges,
or whether such restriction is determined to be necessary because
of hazardous traffic conditions or other safety factors.
B.
Upon the adoption and imposition of any such vehicle
weight or size limit restrictions, the Superintendent of Roads of
Hempfield Township shall erect official weight or size limit signs
on the highways or sections of highways so designated, said signs
to be erected in accordance with the requirements of the Pennsylvania
Vehicle Code.
C.
Duties of Secretary to Board of Supervisors.
(1)
The Secretary to the Board of Supervisors of Hempfield
Township shall note in the minutes of every such meeting at which
such weight or size limit restrictions were adopted the following
information:

The Secretary shall further cause to be recorded in
a separate place a list of all such restrictions imposed, including
but not limited to information designated above, and to make available
to the public, during business hours, such listing for inspection.
D.

E.
It shall be unlawful for any person to operate a motor
vehicle on any highway or section thereof or bridge of the road system
of Hempfield Township in excess of the weight or size limit adopted,
imposed and posted in accordance with this section.
F.
Any person violating Subsection D herein shall be guilty of a summary offense and, upon conviction thereof, shall be sentenced to pay a fine of:
(1)
One hundred fifty dollars for each 500 pounds, or
part thereof, in excess of 3,000 pounds over the maximum allowable
weight if the restriction concerned was determined by the Board of
Supervisors at the time of adoption of said restriction to be necessary
to prevent damage or destruction of said road, section thereof or
bridge.
(2)
Not less than $25 and no more than $100 in all other
cases.

A.
No motor vehicle, trailer or combination thereof or other transportable item shall be operated on any roadway, bridge or portion thereof identified pursuant to the provisions of § 83-17 of this chapter to be subject to a weight limitation or restriction without the owner and/or operator thereof having first obtained a permit for such activity to be issued under the terms of this section.
B.
Permits to be issued by the Secretary to the Board
of Supervisors of Hempfield Township shall include the following:
(1)
A Type 1 permit which authorizes use of a particular
posted highway, bridge or portion thereof by an over-posted-weight
vehicle. It is valid only when carried in the over-posted-weight vehicle.
(2)
A Type 2 permit which authorizes use of a particular
posted highway, bridge or portion thereof by any number of over-posted-weight
vehicles being driven to or from a common destination. This permit
will be issued only upon request of the permittee when the Board of
Supervisors shall determine that it is not feasible to issue a Type
1 permit for each vehicle. Such permit must be posted and maintained
at the point of common destination.
(3)
A Type 3 permit which authorizes use of a number
of specified posted highways, bridges or portions thereof by an over-posted-weight
vehicle. This permit will be issued only if the Board of Supervisors
determines that damage to the posted sections will be minimal due
to the limited number of moves by the vehicle and the short-term use
of said posted section. Such permit is valid only when carried in
the over-posted-weight vehicle.
C.
A permittee shall be required to provide financial security in a form acceptable to Hempfield Township to assure compliance with the excess maintenance agreement required under Subsection E hereof. The amount of security shall be as follows:
(1)
Type 1 and 2 permits shall include:
(a)
Six thousand dollars per linear mile for unpaved
highways to be maintained at a level consistent with the type of highway.
(b)
Twelve thousand five hundred dollars per linear
mile for paved highways to be maintained at a level consistent with
the type of highway.
(c)
Fifty thousand dollars per linear mile for any
highway to be maintained below a level consistent with the type of
highway.
(2)
Type 3 permits shall require a fixed security
of $10,000 for the entire municipality.
D.
The Secretary to the Board of Supervisors of Hempfield Township shall, after consultation with the Township Engineer, fix the financial security to be required for traveling in excess of posted weight over any bridge subject to a restriction pursuant to § 83-17D of this chapter.
E.
The issuance of any permit to exceed a posted weight
limit or limits shall be conditioned on the agreement of the permittee
to accept financial responsibility for excess maintenance of the posted
highway, bridge or portion thereof to be used by the permittee at
the sole discretion of the Township of Hempfield. Such agreement shall
provide for the work to be performed by the Township of Hempfield
or its contractor.
F.
The Board of Supervisors of Hempfield Township shall,
from time to time by resolution, adopt and authorize a permit form
and a schedule of fees to be imposed for the issuance of permits hereunder.
G.
Any person or entity who shall operate a vehicle in excess of a duly authorized and posted weight restriction without first having obtained a permit for the same under the provisions of this section shall, in addition to the fines and penalties set forth in § 83-17 of this chapter, be guilty of a summary offense and, upon conviction thereof, shall be sentenced to pay a fine of not less than $300 nor more than $600, together with costs of prosecution for each offense. Each day of operation in excess of a posted weight limit and each posted roadway in question shall constitute a separate offense.
It shall be unlawful for any person to operate
any motor vehicle upon any highway in the Township that is under construction,
resurfacing or repair, in disregard of any official sign, barricade
or notice that the same is closed to vehicular traffic. Any person
who shall violate any provision of this section shall, upon conviction
thereof, be sentenced to pay a fine of not more than $25 and costs
of prosecution and in default of payment of such fine and costs, to
undergo imprisonment for not more than 10 days.
A.
The following areas upon the highways in the Township
are hereby established as play highways:

B.
The Board of Supervisors is hereby authorized to designate
as play highways, whenever it shall deem such action advisable and
for whatever period of time directed by it, any portion of any highway
in the Township whereon sledding and coasting shall be permitted.
Such highway shall be set apart for the purpose under the direction
of the Board of Supervisors.
C.
No person shall operate any motor vehicle upon any
play highway at any time when such highway shall be so designated,
except in case of emergency and with special permission of the Board
of Supervisors or of the police officer in charge, who shall first
clear such play highway of all persons using such highway for the
purpose for which it was set aside. Any person who shall violate any
provision of this section shall, upon conviction thereof, be sentenced
to pay a fine of not more than $10 and costs of prosecution, and in
default of payment of such fine and costs, to undergo imprisonment
for not more than five days.
The operator of any motor vehicle involved in
an accident in the Township and required by law to report such accident
to any department or agency of the Commonwealth of Pennsylvania, or
any other person required to make such report, shall, at the time
of making such report to the commonwealth, make a written report to
the Board of Supervisors and/or constable of the Township containing
the same information. Any person falling to make the report to the
Board of Supervisors and/or constable hereby required shall, upon
conviction thereof, be sentenced to pay a fine of $10 and costs of
prosecution, and in default of payment of such fine and costs, to
undergo imprisonment for not more than five days.
