This chapter shall be known and may be cited as the "Perkasie Borough Zoning Ordinance of 2012."
The purpose of this chapter is to promote, protect and facilitate the public health, safety, morals and general welfare by:
A. 
Encouraging coordinated and practical community development.
B. 
Providing for proper density of population.
C. 
Securing public safety by providing for airports, civil defense, national defense facilities, disaster evacuation and police protection.
D. 
Providing for adequate light and air, access to incident solar energy and a safe, reliable and adequate water supply for domestic, commercial, agricultural and industrial use.
E. 
Facilitating the adequate provision of sewerage, schools, public grounds, transportation, parking and loading space and other public requirements; as well as preservation of the natural, scenic and historic values in the environment and preservation of forests, wetlands, aquifers and floodplains.
F. 
Preventing blight and the overcrowding of land.
G. 
Avoiding danger and congestion in travel and transportation.
H. 
Avoiding loss of health, life or property from fire, flood, panic or other dangers.
I. 
Giving reasonable consideration, among other things, to the character of the Borough as a whole and of each district and its peculiar suitability for particular uses and structures. To accommodate reasonable overall community growth, including population and employment growth, and opportunities for development of a variety of residential dwelling types and nonresidential uses.
J. 
Giving effect to the policies, proposals and overall program of the comprehensive or development plan for Perkasie Borough of current adoption.
K. 
Providing for the use of land within the Borough for residential housing of various dwelling types encompassing all basic forms of housing, including single-family and two-family dwellings, and a reasonable range of multifamily dwellings in various arrangements, mobile homes and mobile home parks; provided, however, that this chapter shall not be deemed invalid for the failure to provide for any other specific dwelling type.
In interpreting and applying the provisions of this chapter, they shall be held to be the minimum requirements for the promotion of the public health, safety, comfort, convenience and general welfare. Where the provisions of this chapter impose greater restrictions than those of any statute, ordinance or regulation, the provisions of this chapter shall be controlling. Where the provisions of any statute, ordinance or regulation impose greater restrictions than this ordinance, the provisions of such statute, chapter or regulation shall be controlling.
This chapter is designed to carry out the community development objectives as stated in the Comprehensive Plan for the Borough of Perkasie, which is hereby incorporated herein by reference.
A. 
If a court of competent jurisdiction declares any provision of this chapter to be invalid in whole or in part, the effect of such decision shall be limited to those provisions which are expressly stated in the decision to be invalid, and all other provisions of this chapter shall continue to be separately and fully effective.
B. 
If a court of competent jurisdiction should find the application of any provision or provisions of this chapter to any lot, building, tract of land, or other structure to be invalid in whole or in part, the effect of such decision shall be limited to the person, property, or situation immediately involved in the decision, and the application of any such provision to other persons, property or situations shall not be affected.
