There is hereby established a park and playground in the Borough of Pleasant Hills of all of that area of land more particularly described as follows, to wit:
A. 
BEGINNING at a point on the southerly line of Lot No. 843 in the Pleasant Hills Plan of Lots No. 7, of record in the Recorder's Office of Allegheny County, Pennsylvania, in Plan Book Vol. 36, pages 58 to 61 inclusive, said point being common the line dividing lands now or late of A. J. Farrell and the land of H. A. Beam; thence along the southerly line of Lot No. 843 in said Plan, North 83º 38' East a distance of One Hundred Fifty-four and 90/100 (154.90) feet to a point on the southwesterly side of Bruceton Road (Fifty (50) feet wide), (Said Bruceton Road having been dedicated by Deed of Dedication of record in the Recorder's Office of Allegheny County, Pennsylvania, in Deed Book Vol. 36, pages 58-61); thence along the southwesterly side of Bruceton Road by a line curving to the left in a southeasterly direction having a radius of Three Hundred Ten (310) feet, a arc distance of Thirty-three and 61/100 (33.61) feet to a point; thence continuing along the southwesterly side of Bruceton Road, South 50º 58' East a distance of Three Hundred Sixty-two and 68/100 (362.68) feet to a point in the westerly line of property now owned by the Borough of Pleasant Hills, which land is used for sewage treatment plant purposes (formerly and before date of the Borough incorporation owned by the Township of Jefferson); thence along the Westerly line of property owned by the Borough of Pleasant Hills South 23º 22' West a distance of One Hundred Eighty-seven and 58/100 (187.58) feet to a point; thence by a line curving left in a southeasterly direction having a radius of Six Hundred (600) feet, an arc distance of Two Hundred Forty and 29/100 (240.29) feet to a point; thence continuing along said line South 66º 38' East a distance of Twenty-six and 10/100 (26.10) feet to a point; thence continuing along said line North 23º 22' East a distance of One Hundred Twenty and 30/100 (120.30) feet to a point on the Southwesterly side of Bruceton Road aforesaid; thence along the southwesterly side of Bruceton Road aforesaid South 40º 18' 10" East a distance of Forty-six and 61/100 (46.61) feet to a point; thence continuing along the southwesterly side of Bruceton Road aforesaid by a line curving to the left in a southeasterly direction having a radius of Five Hundred Twenty-five (525) feet, an arc distance of One Hundred Ninety and 81/100 (190.81) feet to a point; thence continuing along the southwesterly side of Bruceton Road aforesaid South 60º 7' 35" East a distance of Three Hundred Eighty-eight and 13/100 (388.13) feet to a point; thence continuing along the southwesterly side of Bruceton Road aforesaid by a line curving to the right in a southeasterly direction having a radius of Seven Hundred Fifty (750) feet, an arc distance of One Hundred Seventy-three and 02/100 (173.02) feet to a point; thence leaving Bruceton Road aforesaid and by a line South 40º 44' 30" West a distance of Four Hundred Twenty-six and 44/100 (426.44) feet to line of land now or formerly of D. B. Logan; thence continuing along the line of land now or late of D. B. Logan North 51º 36' 50" West a distance of One Thousand Eighty-five (1085.00) feet to a point; thence still continuing along the line of lands now or late of D. B. Logan by a line South 33º 12' 10" West a distance of Five Hundred Seventy-one and Ninety-five (571.95) feet to a point common to line of land now or late of M. Razumic; thence along line of land now or late of M. Razumic North 38º 31' West a distance of Five Hundred Forty-eight and 34/100 (548.34) feet to a point in the line of lands now or late of R. J. Askin; thence along the line of lands now or late R. J. Askin, North 50º 26' East a distance of Fifty-five (55) feet to a Black Oak; thence continuing along the line of lands now or late of R. J. Askin North 69º 1' 40" East a distance of Five Hundred Fifty-six and 70/100 (556.70) feet to a point; thence still along the line of lands now or late of R. J. Askin and as same goes along the line of land now or late of H. A. Beam North 21º 46' 30" West a distance of Three Hundred Forty-six and 74/100 (346.74) feet to a point at the place of beginning and containing Sixteen and 202/1000 (16.202) acres.
B. 
In addition to those areas specifically identified in §254-1A, the rules and regulations and regulated uses defined in Chapter 254 of the Code of the Borough of Pleasant Hills shall also apply on all public land within the Borough of Pleasant Hills, including, but not limited to, all land owned by the Borough. From the date of enactment of this subsection, the prohibited uses defined in § 254-4 of the Code and the regulated uses defined in § 254-5 of the Code shall apply to all areas within the Borough as described herein.

Editor's Note: This ordinance also provided that its express purpose is to amend existing § 254-1 by the addition of Subsection B. The addition does not abolish the restrictions in the area described in § 254-1A, rather, it is intended to supplement and clarify existing language.
Said land is hereby taken as a park and playground by the Borough of Pleasant Hills in accordance with the authorization contained in the provisions of law for the exercise of eminent domain by the Boroughs of the Commonwealth of Pennsylvania; and the proper officers are hereby authorized to enter upon and use the same for the purposes of this taking.
If damages are not agreed upon, the Borough Solicitor is directed to petition the Court of Common Pleas of Allegheny County, Pennsylvania, for the appointment of viewers for the assessment of same. The Borough Solicitor is further empowered and authorized to do any matter or thing necessary for the accomplishment of this taking.

A. 
Grass areas must not be used for roadways, parking or other purposes which may injure or destroy the turf or landscaping.
B. 
Trees, shrubs, hedges, berries, wild flowers or other flowers must not be picked, cut, broken or injured in any way whatsoever. No person shall climb any tree or attach any swing thereto.
C. 
Buildings, structures, fences, statuary, fountains, benches or signs must not be injured or defaced in any way.
D. 
Paper, rubbish, litter or any refuse whatsoever must not be scattered, but must be deposited in receptacles provided for that purpose.
E. 
Birds, squirrels, rabbits, deer, ducks or any other wild creatures may not be hunted, injured, killed or in any manner molested. Abandonment of any domestic animals (dogs, cats and the like) is likewise forbidden. Any animal found at large may be seized and impounded.[1]

F. 
Drunkenness, disorderly or indecent conduct and profane language are prohibited.[2]

G. 
No person shall clean, polish, grease, lubricate or make repairs to any vehicle, except those of a minor nature and then only in cases of emergency.
H. 
The serving or drinking of beer, liquor or other intoxicating beverages is restricted to the shelter areas and is prohibited on the ball fields, tennis courts, basketball courts, playground areas and any other location other than the shelter area which has been reserved.
I. 
No person shall disturb any picnic or intrude himself or herself on such picnic, without the consent of the parties composing the picnic.
J. 
No person shall post or fix any notice or bill or other writing or printing of any kind on any tree, lamppost, hydrant, curb stone, coping, flagstone, fence, wall, building or other place.
K. 
Loud or excessive noise by using radios, tape recorders, record players or other electronic amplification is hereby prohibited.
A. 
Dogs or any other domesticated animals are not permitted at any time, except when held in leash and under the control of the owner or other person having such animal in charge. Dogs on leash shall not be permitted to use any area normally traversed, such as walks, paths or shelter areas or near benches. Places used for this purpose should be in remote sections of the park.
B. 
Firearms, air rifles, BB guns, bows and arrows, slingshots or any device that can launch a projectile which may do bodily injury are strictly prohibited. This section shall not apply to police or other authorized personnel.
C. 
Recreational fires are prohibited except in stoves or fireplaces provided for that purpose. No person shall throw away or discard any lighted match, cigar or cigarette.
D. 
No public meeting, assemblage, parade or procession may take place without written permission of the Borough Secretary.
E. 
Riding or driving bicycles or any other vehicle is not permitted except on roads and trails provided for such purposes.
F. 
No person shall establish any booth, table or stand for the sale of, nor hawk or sell any article whatever, without the written permission of the Borough Secretary.
G. 
Games, contests or sports are permitted only in areas designed for such use, and in no case shall such use be permitted in areas where lawns or planting may be injured or where such games or contests may interfere with any of the regulations in this article.
H. 
To reserve a shelter, a permit must be obtained from the Borough Secretary. No picnic or other gathering shall be held by citizens of communities other than Pleasant Hills, or by organizations from communities other than Pleasant Hills or any group whose makeup is predominantly of persons from without the Borough of Pleasant Hills without first obtaining a written permit from the Borough Secretary and depositing a fee according to the schedule of fees and policies established by Borough Council. The cost of repairing any damage, cleaning the shelter area or replacing equipment and tables shall be the burden of the citizen making the reservation. No shelter shall be reserved by a group that is larger than can be accommodated by the size of the shelter.
I. 
Shelters may be reserved on a first-come basis on the first working day of the year by citizens of the Borough of Pleasant Hills according to the schedule of fees and policies established by Borough Council. The cancellation policy will be:
(1) 
If canceled at least 60 days prior to the event, a full refund will be made.
(2) 
If canceled between 20 and 59 days of the event, 50% of the deposit will be refunded.
(3) 
No refund shall be made if canceled less than 20 days before the event.
J. 
All public parks and park areas and structures located thereon shall be closed between the hours of 11:30 p.m. and 7:00 a.m., except to authorized personnel, individuals engaging in official business and those individuals or groups who have obtained a permit from the Borough Secretary permitting them to remain in any such parks, on such lands, or within such structures beyond the regular closing hour.
K. 
Persons lying on, sleeping on, or walking on picnic tables or benches is prohibited.
A. 
No motor vehicle shall be permitted to park except in such areas as shall be designated and marked for that purpose.
B. 
A rate of speed for any motor vehicle exceeding 15 miles per hour is prohibited.
C. 
Operating any vehicle in a reckless or negligent manner or in excess of the posted speed limit is prohibited.
D. 
The use of motor scooters, motorcycles, minibikes, unlicensed motor vehicles, or the like, is forbidden.
A. 
Any person, persons or organizations violating any of the provisions of this article shall be subject to a fine as permitted by state law, to be recovered by the Borough before any District Justice.

B. 
Each violation hereunder shall constitute a separate offense, subject to the penalty provided in the preceding subsection.
