The purpose of the O-1 District is to provide for the demand for suburban business and professional offices, including the supporting facilities that such offices may require, and to meet the needs of the resident population for convenience in obtaining professional services.
In this district, the land may be used and buildings and structures may be erected, altered or used for the following purposes and no other:
A. 
Permitted uses:
(1) 
Accessory uses on the same lot with, and customarily incidental to, any of the conditional uses authorized in the District.
(2) 
Essential services.
B. 
Conditional uses:
(1) 
Professional and business offices and business services, subject to the following express standards and criteria:
(a) 
The site shall have direct access to a street classified as arterial or collector.
(b) 
Ingress, egress and internal traffic circulation shall be designed to ensure safety and accommodate peak demands without hazard or delay.
(c) 
All lighting shall be shielded away from the street and adjacent lots.
(d) 
All materials and equipment shall be stored in a completely enclosed structure or shall otherwise be screened by a six-foot hedge or fence.
(e) 
No shipping or receiving shall be permitted within 500 feet of residential use or zoning classification between the hours of 7:00 p.m. and 7:00 a.m.
(f) 
Medical offices and clinics and similar offices with frequent turnover of clients shall provide, in addition to the required one parking space per 300 square feet of floor area, an additional six parking spaces per professional staff.
(g) 
Adequate parking shall be provided for the proposed use so that overflow parking on Borough streets shall not be permitted.
(h) 
Buildings which are not initially designed to house medical offices or clinics shall indicate compliance with the additional parking requirements for such uses prior to obtaining approval for a change in occupancy which includes such uses.
(i) 
The maximum height of building required by § 374-82 may be increased by Borough Council to no more than seven stories and 90 feet, subject to:
[1] 
Yards adjoining residential development or zoning classification shall be increased one foot for every one foot of building height in excess of 50 feet.
[2] 
Yards adjoining nonresidential development or zoning classification shall be increased by one foot for every two feet of building height in excess of 35 feet.
[3] 
Borough Council shall determine whether differences in elevation between the site proposed for development and the adjacent properties are such that the increase in height of the proposed office building may negatively impact existing or future development of adjacent properties.
[4] 
At least one side of the site proposed for construction of an office building which is to exceed three stories in height shall adjoin a nonresidential zoning classification.
(2) 
Branch banks, employee dining facilities, pharmacies and other supporting commercial facilities, subject to the requirements of § 374-30 and the following express standards and criteria:
(a) 
Borough Council shall determine that the proposed supporting facilities are directly related to the principal use of the office building.
(b) 
The proposed supporting facilities shall not exceed 5,000 square feet of gross floor area of building.
(c) 
Except for employee dining facilities, all supporting facilities shall be located on the street level or ground level of the building.
(d) 
Employee dining facilities such as automats, cafeterias, snack shops or lunch rooms which are only open during normal business hours of the principal use and which do not serve the public, except as guests of employees, may be located on any floor of the building and may exceed the 5,000 square foot gross floor area limit upon approval of Borough Council, if such increase in floor area is necessary to serve the projected number of employees.
(e) 
Pharmacies shall be limited to establishments which are related to medical professional offices.
(f) 
Branch banks shall be permitted only in office developments which contain 100,000 square feet or more of gross floor area.
(g) 
Branch banks which have drive-in windows shall locate the window so as to not interfere with efficient traffic circulation on the site and shall provide adequate standing lanes which shall not be counted in determining the parking area required for the authorized uses.
(h) 
Any outdoor dispensing facility, including but not limited to such facilities as banking machines, whether freestanding or included in the principal building, shall be required to provide at least four parking spaces in addition to those required for the principal and accessory uses on the site which shall be located within 50 feet of the dispensing facility and which shall not interfere with the safe and efficient pedestrian and traffic circulation on the site.
(i) 
Parking shall be provided for the supporting facilities based on the ratio required in § 374-88 for retail businesses. No parking shall be required for employee dining facilities which are restricted to employees and their guests.
In this district, the following area and bulk regulations shall apply to the uses permitted:
A. 
Minimum site area: two acres.
B. 
Minimum lot width: 100 feet.
C. 
Maximum lot coverage: 20%.
D. 
Minimum front yard:
(1) 
From property line: 50 feet
(2) 
From centerline of street: 75 feet.
E. 
Minimum rear yard:
(1) 
Adjoining residential use or development: 50 feet
(2) 
All others: 35 feet.
F. 
Minimum side yard:
(1) 
Adjoining residential use or development: 50 feet.
(2) 
All others: 35 feet.
G. 
Maximum height of building: See § 374-82.
H. 
Parking requirements: See § 374-88.
I. 
Buffer area. A buffer area, as defined by this chapter, shall be provided along all property lines which adjoin single-family development or single-family or civic district zoning classification. The buffer area shall be at least six feet in depth as measured from the property line.
In this district, a loading and access area shall be provided to the rear or side of all commercial buildings. This area shall be sufficiently large so that any vehicle, while servicing such commercial building, shall not protrude into any street or sidewalk and this area, in all cases, shall be at least 20 feet in depth. The purpose of this area shall be to provide rear or side access to the building for fire and police protection and for the loading and unloading of merchandise, and to protect such property and the occupants thereof.
Borough Council shall hear and decide applications for conditional uses in accordance with the procedures specified in § 374-118 of this chapter.
